In June 2010, the Tennessee Department of Environment and Conservation (TDEC) imposed an $11.5MM multi-year penalty on TVA for waste releases. By July 1, 2010, over 3.5 million cubic yards of ash had been dredged and excavated. The Emory River reopened to the public on May 29, 2010, as efforts continued for the design and implementation of closure processes for remaining ash and infrastructure. The year also saw regulatory changes, including fee adjustments and new design criteria for waste management. For more information, contact TDEC officials.

TVA Kingston Update • 6/14/2010 – TDEC issues $11.5MM multi-year penalty to TVA for release • Time Critical work to remove ash from river ended 6/28/2010 • 2,760,656 CY dredged as of 7/1/2010, with additional 749,073 CY excavated, for a total of ~3.5MM CY • As of 7/2/2010, 2.688 MM tons ash shipped to Arrowhead Landfill in Perry County Alabama . • Emory River reopened to Public on May 29, 2010 • Work continues for design and implementation of closure for remaining released ash and relic structure.

Regulatory Changes Not surprisingly, with the economy being down significantly, Tipping fees and State appropriation dollars were down as well. The main thrust of this year’s rulemaking effort revolved around adjustments to fees (the first major adjustment to Tennessee’s fee schedule since Subtitle D was adopted).
