  4. Key Definitions • Federal-aid Highway - generally all routes except rural minor collectors or local roads. • National Highway System - Interstate and a number of designated principal urban and rural arterials. • 23 U.S.C. Section 118(e)

  5. 23 U.S.C. Section 118(e) “Funds … may be expended for construction of access and development roads that will serve resource development, recreational, residential, commercial, industrial, or other like purposes.”

  7. Federal-State Cooperation • Each State Highway Department shall be authorized to: • “Make final decisions for the State in all matters relating to…” • “Take such other actions on behalf of the State as may be necessary to comply with the Federal laws and regulations in this part”

  9. Federal-Aid Project Oversight Responsibility Agreement The Alaska DOT assumes FHWA role for assuring compliance with Federal Laws, Policies & Title 23. The Alaska DOT shall develop procedures to implement responsibilities under this agreement.

  10. Alaska DOT Assumes Project by Project Responsibility For: • Design, plans, specifications, estimates, right-of-way certifications, contract awards and inspection/final acceptance of projects. • DOT is not relieved of the responsibility even thought the project may be under the supervision of another public agency.
