  3. Les Incoterms Les Incoterms (en anglais International COmmercial TERMS) sont des règles internationales établies pour uniformiser l’interprétation des termes des contrats commerciaux. Reconnus par la plupart des Etats, ils offrent aux transactions internationales un cadre plus précis. Les Incoterms actuels (version de 2000) sont classés en quatre groupes. Chacun d’eux précise les obligations du vendeur et de l’acheteur en matière de transfert de frais et de risques. Chapitre1

  5. Les Incoterms • Les Incoterms ont été publiés pour la première fois par la Chambre de Commerce Internationale en 1936. Ils sont régulièrement mis à jour (en 1953, 1967, 1976, 1980 et 1990 et 2000). • Ils précisent les obligations des parties, et notamment le partage des frais et le partage des risques. En fonction de l’Incoterm utilisé, chacun peut retrouver rapidement ce qu’il est tenu de faire au cours de l’opération. • Les Incoterms sont pratiquement universels ; cependant les Etats-Unis utilisent des Incoterms avec une terminologie spécifique. Les incoterms délimitent les responsabilités mais également le service offert au client ; ils constituent donc un argument commercial à part entière. Chapitre1

Les Incoterms Les Incoterms définissent avec précision, par un sigle de trois lettres, les obligations du vendeur et de l’acheteur 4 familles 13 incoterms : - Le partage des frais et des risques - « E » : départ (obligations minimales) - « F » : transport principal non acquitté - « C » : transport principal acquitté - « D » : arrivée (obligations maximales) Chapitre1

Ex Works (named place) • Group F - Main Carriage Unpaid: • FCA Free Carrier (named place) • FAS Free Alongside Ship (named loading port) • FOB Free On Board (named loading port) • Group C - Main Carriage Paid: • CFR Cost and Freight (named destination port) • CIF Cost, Insurance and Freight (named destination port) • CPT Carriage Paid To (named destination) • CIP Carriage and Insurance Paid to (named destination) • Group D - Arrival: • DAF Delivered At Frontier (named place) • DES Delivered Ex Ship (named port) • DEQ Delivered Ex Quay (named port) • DDU Delivered Duty Unpaid (named destination place) • DDP Delivered Duty Paid (named destination place) Chapitre1

  9. Utilisation des incoterms - Les Incoterms sont rédigés d’une manière très générale, pour correspondre au plus grand nombre de situations. Ils doivent donc être précisés en fonction du contrat. • chaque Incoterm doit être accompagné des lieux précis où doivent s’opérer les transferts de risques et de frais : ainsi il faut préciser dans le contrat qu’on s’appuie sur un FOB Marseille, ou un CIF Rotterdam... • Dans le cas d’Incoterms polyvalents, il faut également préciser le mode de transport retenu, . Pour les utiliser, il suffit d’indiquer dans le contrat que le transport est régi par un Incoterm de la Chambre de Commerce Internationale, version 2000. Chapitre1
