  2. Excepted Service Appointing Authorities • Excepted by Statute, Executive Order, or OPM action • OPM’s Governmentwide excepted authorities listed under Schedules A, B, and C • No public notice required by OPM • No time in grade required by OPM

  3. Excepted Service Appointing Authorities • Schedule A – Cannot use traditional examining methods and not subject to OPM qualifications(e.g., Attorneys, Presidential Management Fellows Program) • Schedule B – Can not hold open competition and must meet OPM qualifications (e.g., Student Education Employment Program, Federal Career Intern Programs • Schedule C – Political appointees

Schedule A – Appointment of Persons with Disabilities • Regulation published in Federal Register on July 26, 2006 • Applies to appointment of persons with severe physical disabilities, mental retardation, or psychiatric disabilities • Improves the Federal Government’s ability to hire persons with these disabilities • Designed to remove barriers and increase employment opportunities for these individuals

Schedule A – Appointment of Persons with Disabilities New Regulation: • Broader certifying entities: • A licensed medical professional (e.g., a physician or other medical professional certified by a State, the District of Columbia, or a U.S. territory to practice medicine) • A licensed vocational rehabilitation specialist (i.e., State or private) • Any Federal agency, State agency, or agency of the District of Columbia or a U.S. territory that issues or provides disability benefits

Schedule A – Appointment of Persons with Disabilities New Regulation (continued): • 5 CFR 213.3102 (u) now replaces the following three Schedule A appointing authorities: • 5 CFR 213.3102 (t) (mental retardation) • 5 CFR 213.3102 (u) (severe physical disabilities) • 5 CFR 213.3102 (gg) (psychiatric disabilities)

Schedule A – Appointment of Persons with Disabilities New Regulation (continued): • Clarifies the following employment options: • Temporary appointments • Time limited appointments • Permanent appointments • Clarifies distinctions between proof of disability and certification of job readiness • Retains noncompetitive conversion to competitive service upon two years service
