LES RR ET LA CMRTHE RR AND THE CMR • Délai pour agir selon les RR = 2 ans • Délai pour agir selon la CMR = 1 an • Le transporteur multimodal a tout intérêt à baser son contrat avec le camionneur sur les RR • Time for suit according to the RR = 2 years • Time for suit according to the CMR = 1 year • The multimodal carrier may use the provisions of the RR to establish the contract with the haulier (c) International Road Transport Union (IRU) 2010

APPLICATION DES RR EN VERTU DU CONTRAT PRIVEAPPLICATION OF THE RR FOR THE PRIVATE CONTRACT JAKARTA– HAMBURG – PRAHA Hamburg – Praha : Le tribunal allemand ou tchèque appliquera la CMR si l’Allemagne et la République tchèque n’ont pas adhéré aux RR En outre, il appliquera l’article 7.3 de la CMR si le contrat ne contient pas la mention selon laquelle le transport est soumis à la CMR The German or Czech Court will apply the CMR if Germany and the Czech Republic do not adhere to the RR Moreover, it will apply Article 7.3 of the CMR if the contract does not state that the carriage is subject to the provisions of the CMR (c) International Road Transport Union (IRU) 2010

Port to Port Shipment (a) Each vehicle (whether consisting of a single unit, articulated unit or a trailer or semitrailer) together with any container(s), flat(s), pallet(s), packages(s) or other equipment and together with their respective contents (if any) shall be deemed to be one package or unit for the purposes of Art. IV, para 5 (a) of the Hague Rules.  (b) The Carrier shall be entitled to limit its liability to 666,67 SDRs per package or unit, and Art. IV, para 5 (a) ofthe Hague Rules shall be read as though the words "2 SDRs per kg of gross weight of the Goods lost or damaged, whichever is the higher,"were deleted.
