KENYA WORKPLAN • PURPOSE • To ensure that an increased number of indigent children at the Children’s Court access justice and to enhance children rights and legal aid focused laws through collaboration.
KENYA WORKPLAN • MEMBERS • The Law society of Kenya • The National Legal Aid ,Education & Awareness Program • The CRADLE- The Children Foundation • The Law Reform Commission • The Judiciary
KENYA WORKING PLAN • Host of competences needed • The judiciary which is ultimately responsible for the dispensation of justice, will pick up best practices and ensure that the court process and systems are sensitive to the vulnerable and special needs of children
KENYA WORKPLAN • The LSK which is a statutory body that regulates the conduct of practicing advocates will facilitate provision of legal services through the advocates. This is in line with their core mandate of assisting the judiciary in dispensing justice.
KENYA WORKPLAN • National Legal Aid and Awareness Program whose mandate is to enhance access to justice for the poor and vulnerable through provision of legal services and who have funds to support provision of legal services will pay honoraria to the advocates who will take up matters.
KENYA WORKPLAN • NALEAP will also give valuable input in lobbying and advocating for the enactment of a legal aid bill NALEAP has also been mandated by the Ministry of Justice and Constitutional Affairs to set up a legal aid pilot project will be paying them honoraria
KENYA WORKPLAN • The CRADLE a local child rights organization possesses relevant technical expertise in child rights issues and has over the years developed effective procedures and systems for providing legal aid to indigent children and will participate in the actual service delivery and psychosocial support.
KENYA WORKPLAN • With its background and vast legal knowledge in domestic and international child rights law coupled with The CRADLE’s role in coordinating the Parliamentary Caucus on Children, it will therefore give valuable input in lobbying and advocating for the enactment of child focused laws
KENYA WORKPLAN • They also train and equip several pro bono lawyers who are also members of the Law Society with relevant knowledge and ability to litigate children’s matters, The CRADLE will assist in ensuring that matters are referred to competent pro bono advoc
KENYA WORKPLAN • The Kenya Law Reform Commission whose mission is to contribute to systematic reform, harmonization and simplification of the laws of Kenya will contribute immensely to the proposed legislation.
KENYA WORKPLAN • The partners therefore, bring in a cocktail of expertise and experience which will effectively ensure achievement of the specific and overall objective professionally and cohesively.
KENYA WORKPLAN • OUTPUTS • Access to justice by children in conflict with the law or those needing protection of the law at the children’s court enhanced through legal representation and psychosocial support. • Limited direct support, impact litigation, enhancing access through the pro bono scheme
KENYA WORKPLAN • Information Management at the children’s court improved and made accessible to stakeholders. • To have a data base at the children’s court in readiness for the ICT initiative to be undertaken by the judiciary.
KENYA WORKPLAN • Child rights and legal aid focussed laws enhanced. • Come up with a Child Justice Bill and The Legal Aid Bill.
KENYA WORKPLAN • Monthly monitoring and quarterly reporting carried out
KENYA WORKPLAN • The collaboration has been working well • The LSK & NALEAP has already recruited many pro bono lawyers. NALEAP has committed to pay honoraria
KENYA WORKPLAN • The Judiciary has already provided the space to have a clinic at the children’s court • The Law Reform Commission and The CRADLE are waiting to implement the program
KENYA WORKPLAN • The Challenges • Obtaining feedback from all NWG • Different priority areas by NWG • Lack of funds
KENYA WORKPLAN • RESULTS OF NWG • Active involvement of key stakeholders in the above process. • New and reformed laws and policies are implemented and enforced by government and law enforcement authorities.
KENYA WORKPLAN • New and reformed laws and policies effectively address the root causes of child rights violations. • New and reformed laws effectively address all legal aid issues
