  2. The Players • Anthony Maglica – Owner and founder of Mag Instruments, Inc. Acted as President • Claire Maglica – Life partner of Anthony. Acted as supervisor of operating, marketing, personnel and purchasing department. • Stephen Halasz – Son of Claire. Acted as Vice President of Mag Instruments, Inc. • Christopher Halasz – Son of Claire. Acted as Director of Research and Development

  3. The Company • Mag Instruments, Inc. manufactures Maglite Flashlights. The Maglite is a powerful, durable flashlight that has become the standard issue gear used by police officers in the United States • It is a multimillion dollar company

  4. The Background Claire met Anthony when she was hired to decorate his machine shop. The two quickly became an item. Claire took his surname but the couple never married, although they lived for many years as a married couple. The couple worked together to grow Mag Instruments, Inc. They were also very popular and visible on the social scene.

  5. The Issue Claire discovered Anthony was planning to leave the company to his children from a previous marriage. Claire filed a palimony suit for breach of contract, breach of partnership agreement, fraud, breach of fiduciary duty and quantum merit. Claire sought 200 million in damages.

  6. The Courts After a jury trial in Orange County Superior Court, Claire was awarded 84 Million dollars. The California Court of Appeals reversed this decision. The court stated the award was incorrect because the damages should have been the value of her services not the amount of the benefit of her services. Rather than face a new trial Claire settled for 29 Million.
