  12. Section 106 Process • Required by Army Corps of Engineers Section 404 Permit for airport expansion • Required under the National Historic Preservation Act to minimize the impacts of the restoration design on the historic resource of Rockefeller Park

MOA Requirements • Nominate Rockefeller Park to the National Registry of Historic Places • Develop Rockefeller Park master plan • Submit final construction plans to Consulting Parties for review • Allow Consulting Parties opportunity to salvage stone wall material slated for removal • Develop construction project signage program • Establish an adaptive management fund • Monitor stream restoration for five years

MOA Status • Rockefeller Park nomination to the National Registry of Historic Places complete • 100% design plans submitted to Consulting Parties complete • Internal coordination on Rockefeller Park Master Plan commenced • Restoration monitoring plan under development • Signage program under development • $250,000 post construction adaptive management fund established

MOA Requirements • Protect contributing trees during construction • Remove dead trees and some invasive trees within project limits • Eliminate invasive trees that threaten stone walls within the project limits • Provide replacement trees for those that expire after planting • Protect stone walls during construction • Construct new walls using form lined concrete and closely match existing stone pattern/color
