  1. The regulatory environment in the European Union How can ETSI help?

  2. Directives & regulations (equipment) Radio & Telecommunications Terminal Equipment Directive (1999/5/EC) Radio Spectrum Decision 676/2002/EC

  3. Directives & regulations(networks and services) Regulation (2887/2000) Unbundled access to the local loop Framework Directive (2002/21/EC) Authorisation Directive (2002/20/EC) Access Directive (2002/19/EC) Universal Service Directive (2002/22/EC) Privacy Directive (2002/58/EC)

  4. Directives & regulations(sector-specific) …and many more. Automotive EMC Directive (2004/104/EC) Marine Equipment Directive (96/98/EC) Single European Sky Medical Devices Electronic Fee Collection

  5. Directives & regulations (safety) Low Voltage Directive (73/23/EC) Council Rec on limitation of EMF exposure to General Public (1999/519/EC) « Physical Agents Directive » (2004/40/EC)

  6. Directives & regulations How can ETSI help?

  7. What is ETSI? European Telecommunications Standards Institute European Standards Organisation (98/34/EC) Association of Industry players… …manufacturers, network operators, service providers, administrations, users, industry associations… … with direct participation

  8. Directives & regulations (equipment) Radio & Telecommunications Terminal Equipment Directive (1999/5/EC)

  9. What does a manufacturer need to do? Meet the “essential requirements” • health & safety • electromagnetic compatibility • avoidance of harmful interference (radio equipment only) • possibly others, if invoked by the Commission Declare conformity Carry out « essential radio test suites » Meet national radio interface regulations Inform member state (if using non-harmonised radio spectrum)

  10. How can ETSI help (1/3)? How do I meet essential requirements? Are there any others? Harmonised Standards Harmonized Standards??

  11. Other essential requirements • Access to emergency services (3.3e) • Ships using inland waterways (EC Decision 2000/637/EC) • Marine distress & safety equipment(EC Decision 2004/71/EC) • Marine Identification System (EC Decision 2003/213/EC) • Avalanche beacons (EC Decision 2001/148/EC)

  12. Harmonised Standards Where apparatus meets the relevant harmonised standards or parts thereof whose reference numbers have been published in the Official Journal of the European Communities, Member States shall presume compliance with those of the essential requirements referred to in Article 3 as are covered by the said harmonised standards or parts thereof. [Article 5.1]

  13. Harmonised Standards • European Standards (EN) • Produced under a mandate from the European Commission • And adopted by Member States (98/34 committee) • Implement essential requirements of a « New Approach » Directive (e.g. R&TTE, EMC) • Adopted by National Standards Organisations • Cited in the Official Journal of the European Union • Member statesrequired to presume conformity

  14. Harmonised Standards Identify « essential radio test suites » necessary before placing on the market Identify technicalrequirements necessary to meet regulatory objective (essential requirements) Mandate M/284 Standardise aspects not relevant to the Directive separately Only the part of the standard relevant to the Directive is cited in the OJEU

  15. Harmonised Standards MSG: GSM DECT: DECT TETRA: TETRA TM4: Fixed Radio Links SES: Satellite Earth Stations ERM: Land-mobile radio, Amateur Radio, Citizens’ Band, RFID (ERM TG34) ERM/MSG TFES: IMT-2000 BRAN: HIPERACCESS, 5 GHz RLAN ERM:2,45 GHz RLAN

  16. Harmonised Standards ERM: Electromagnetic Compatibility, Meteorological Aids, Avalanche Beacons, Ultra Wide Band (ERM TG31a), Broadcast transmitters, professional audio/video ERM: Marine radio, Short-range devices (ERM TG28), Paging, Cordless telephones, Radar, Medical Implants, Road Transport & Traffic Telematics

  17. Harmonised Standards Co-ordinated by OCG Steering Committee OCG_RTTED

  18. How can ETSI help (2/3)? How do I meet national radio interface regulations? Harmonised Frequencies …working with CEPT

  19. Radio Spectrum Access CEPT-ETSI MoU ETSI CEPT HarmonisedStandard Recommendation or Decision on spectrum allocation National licence regimes plus interface regulations

  20. CEPT - ETSI MoU Overall ETSI view ETSI CEPT ETSI Liaison Officer Working Groups(adopting) Decision onspectrum ETSI Member Project Teams(drafting) Individualview

  21. Spectrum: How do we get an ETSI view? • Basic description of application • Simple technical description • Current ETSI standards • Justified spectrum requirements • Possible compatibility issues • Market forecasts • Traffic evaluation • Economic/social benefit • Market window • Requested action from CEPT System ReferenceDocument Proforma EG 201 788

  22. Spectrum: How do we get an ETSI view? AffectedETSI TBs System ReferenceDocument Have all interested parties been consulted? Is there consensus? TC ERM SRDoc to CEPT Resolution by members of affected TBs

  23. Example: 2W RFID working at UHF ETSI TR 101 445SRDoc CEPT EN 302 208Harmonised Standard Proposed modification to annex 11 of CEPT/ECC/Rec 70-03 National licence regimes plus interface regulations

  24. How can ETSI help (3/3)? National frequency allocations Harmonised Frequencies What about legal certainty? I want global markets! …working with the European Commission… …Radio Spectrum Decision 676/2002/EC

  25. The problem… Manufacturer needs to know local frequency regulations Frequencies are managed on a national basis: CEPT Recommendations not enforceable at a European level Inform member state 4 weeks before marketing equipment Inform user of national restrictions on use

  26. The Radio Spectrum Decision Radio Spectrum Policy Group European Parliament, CEPT and ETSI as permanent observers Member states advise EC on spectrum requirements to support EU policy initiatives e.g. Broadband Access Road Safety Access for people with disabilities

  27. The Radio Spectrum Decision Radio Spectrum Committee European Commission requests CEPT to provide frequency allocations in support of EU policies CEPT output codified into a Commission Decision Legal certainty ! CEPT and ETSI are permanent observers

  28. The Radio Spectrum Decision Spectrum Tables Member States to notify National Frequency regulations to the Commission Comission to publish in a common format National regulations to be transparent, even if not harmonised

  29. The Radio Spectrum Decision International Negotiations World Radio Conference (WRC) CEPT will continue to establish European Common Positions Commission to communicate with Parliament & Council for political support Aim for global harmonisation where possible

  30. Example: automotive short-range radar Radio Spectrum Committee Request (mandate) to CEPT on frequencies for UWB vehicle radar at 24 GHz CEPT/ECC Decision (04)10 Commission Decision 2005/50/EC (Jan 2005) ETSI Harmonised Standard EN 302 288 (Jan 2005) Legal certainty for placing on the market and use

  31. Directives & regulations(networks and services) Regulation (2887/2000) Unbundled access to the local loop Framework Directive (2002/21/EC) Authorisation Directive (2002/20/EC) Access Directive (2002/19/EC) Universal Service Directive (2002/22/EC) Privacy Directive (2002/58/EC)

  32. How can ETSI help? List of Standards (article 17) to « encourage » harmonisation Framework Directive? …may be made compulsory for interoperability (article 17) or access (Access Dir. Art 5.2) OCG ECNS SR 002 211 Mandate M/328 STF 254 COCOM subgroup reviewing results

  33. How can ETSI help? Standards for interoperability of iDTV (article 18) Interactive digital TV? Mandate M/331 EBU/CENELEC/ETSI JTC Broadcast STF 255 TR 102 282 Standards to follow

  34. How can I contribute? • Membership of ETSI is open to any organisation with an interest in telecommunications (European or not) • Harmonised Standards produced by Technical Committees of experts drawn from members • Funded Specialist Task Forces to accelerate critical work • Public Approval Process managed by National Standards Organisations
