What is the CSA? • Instituted by the DOT’s FMCSA (Federal Motor Carrier Safety Administration) • CSA stands for “Compliance, Safety, Accountability” • Provides a better view of how well commercial carriers and drivers are complying with the safety rules • Uses the SMS (safety measurement system), which uses data from inspections and crash reports, to determine if early interventions are necessary. • No new compliance regulations result from the CSA 2010

  6. What is the SMS? “The Motor Carrier Safety Measurement System (SMS) is a tool used by FMSCA and State partners to evaluate a carrier’s safety performance.” URL: ai.fmcsa.dot.gov/sms/

  7. CSA Methodology - BASICs • Each category has its own BASIC (behavior analysis and safety improvement categories) measure. • Each BASIC measurement is calculated using its own formula

CSA - BASICs The 7 BASICs for the SMS system are: • Unsafe Driving (speeding, seatbelt use) • Fatigued Driving (Hours-of-Service) • Driver Fitness (med cards, CDL license) • Controlled Substances and Alcohol • Vehicle Maintenance • Cargo-Related (BASIC score not public) • Crash Indicator (BASIC score not public)

  10. Alerts are posted if the violation stats in a BASIC reaches a certain threshold. When this happens, the carrier may be prioritized for an intervention and roadside inspection.

  19. CSA Methodology – Violation Weights A severity weight from 1 (least severe) to 10 (most severe is assigned to each application violation. For vehicle crashes, the highest severity weight is 3 (indicating that a hazmat release and an injury or fatality occurred). A time weight of 1, 2 or 3 is assigned to each applicable violation based on how long ago a violation on the inspection was recorded. Violations recorded in the past 12 months receive a time weight of 3. Violations recorded between 12 and 24 months ago receive a time weight of 2. All violations recorded earlier (older than 24 months but within the past 36 months) receive a time weight of 1. The time severity rate is simply the time weight multiplied by the severity weight

SMS – Things to Note • Carriers get their own access to the SMS and get more information than can be seen by the public. • The percentile ranking for Cargo-Related and Crash Indicator BASICs are not available to the public, but is available with your own access. • Carriers do not inherit a new drivers’ past violations with other companies.

SMS – Thing to Note • All inspections and crashes will remain part of the carrier’s record for a period of 2 years (unless overturned by the DataQs system) • Carriers and drivers do not need to register for the CSA nor is their any time of mandatory training requirement. • The CSA does not change any FMCSA regulations.

SMS – Thing to Note • Driver information cannot be found on the SMS, but can be reviewed (if you have obtained a release from the driver) from the FMCSA’s Pre-Employment Screening Program (PSP) (www.psp.fmcsa.dot.gov) • The FMCSA does not have the authority to remove drivers from the road; state authorities, however, do.

  25. SMS – Thing to Note • Tickets and warning that drivers receive while operating their personal vehicles do not count in the SMS.

  26. Intervention Based on a carrier’s BASIC stats, they can be targeted for an intervention.

  27. Intervention 1st Phase • warning letter • carrier access to safety data and measurement information • targeted roadside inspection – occur at temporary roadside inspection locations where SMS information is available • a written response is not required, but compliance is highly recommended

Intervention 2nd Phase – Continued investigation (if necessary) • Offsite investigation – information is gathered on carrier and questions asked by phone and e-mail • Onsite focused investigation – focus on targeted BASICs (usually one or two) and occur at carrier’s place of business • Onsite comprehensive investigation – focus on full compliance with DOT regulations, and are usually brought on by broad and complex safety problems

Intervention 3rd phase (follow-up) • Notice of violation • Formal notice of safety alert • No civil penalty involved • Requires written response to halt further investigation • Notice of claim - issued in cases where regulatory violations are severe enough to warrant fines • Operations Out-of-Service Order – requires the carrier to cease all motor vehicle operations

  30. Red Flag Violations The following violations 11 “red-flag” violations always warrant a follow-up investigation:

  31. DataQs dataqs.fmcsa.dot.gov “DataQs is an electronic means for filing concerns about Federal and State data released to the public by the FMCSA.” Any incorrect information listed on a carrier’s SMS results can be challenged through the DataQs system.

  32. DataQs From the DataQs website, click the register online button to start a new account. To gain Motor Carrier access rights, you will need to know your FMCSA PIN number. You can still contest data, however, with only public access

  34. DataQs To challenge data in the SMS system, click on “Add a Challenge” after logging on into the system. (Note: data kept by the State and data kept by the SMS are separate. Correcting information in the SMS system does not mean that the data State’s data has also been corrected.)
