The USAF and the 386 ECONS have been prejudicing and and excluding a small business from the competition based on a perceived lack of business integrity, in effect making a negative responsibility determination, without referring the matter to the Small Business Administration under the Certificate of Competency procedures. They have been discriminating small businesses which is a direct violation of Small Business Act.<br>

Introduction: In accordance with Federal Acquisition Regulations Part 10, the extent of Market Research conducted was based upon the following factors: complexity, estimated dollar value, past acquisition history, and implementation timelines of the requirement. Based upon the assessment of these factors, it was determined that market research would be conducted utilizing two techniques: (1) Assessment of local market conditions; and (2) Researching previous acquisition history. 2. Requirements: The Concrete BPA provides the delivery of dry mix cement and bagged dry concrete mix to include Al Udied Air Base, Camp Arifjan, Ali Al Salem Air Base, Kuwait City, Abdullah Al Mubarak Air Base, and all points in between. 3. Previous Acquisition History: The current Concrete BPA (FA5703-11-A-0001) was awarded as a four year Blanket Purchase Agreement to Al Musaire. The awardee is a locally owned Kuwaiti business. At the time of award for the current contract, it was determined to be a sole source. According to the previous Civil Engineer Commander, Al Musaire was the only contractor able to provide quality concrete. 4. Market Research Conducted: a.Although the previous BPA was written as a sole source, the BPA starting in FY15 will not be a sole source. Contractors performing construction projects on base utilize multiple different concrete vendors in Kuwait. These projects have been technically acceptable by our civil engineers. Therefore, a sole source justification would not be acceptable. b. Researching previous acquisition history. See paragraph 3 above. c.Commercial Practices. Based on a previous SF44 purchase for concrete delivered to Al Jaber Air Base, FA5703-15-M-0050, it can be determined that this requirement will be satisfied using commercial practices. This promotes local contractors to fulfill this requirement using standard operation procedures to provide a service commonly requested by the public.

Thumrait Air Base, Oman, utilizes a concrete BPA due to their fluctuations in fuel costs and current projects. Al Udied utilizes the current BPA managed here at Ali Al Salem Air Base, The market research from Thumrait Air Base, Oman, and Al Udied solidified the fact that this requirement can be satisfied by local contractors and that a BPA is the most suitable contractual vehicle. 6. Small Business Involvement: Not applicable. The focus of this acquisition will be geared towards locally owned businesses. This effort supports host nations relations by displaying a business relationship with the host country.
