  3. In a very small nutshell • Safeguards apply to all Bank-managed investment lending (inc. GEF, MP, CF, IFAD) • The Recipient is responsible for applying the policies to each Bank-managed loan/credit/grant • Within the Bank, Safeguard Policies Review and Clearance is a decentralized function with a centralized coordination/dispute resolution mechanism (Quality Assurance and Compliance Unit – QACU) SP & BioCF Overview - December 15, 2005

Definition of Categories • Category A - likely to have significant adverse environmental impacts that are sensitive, diverse or unprecedented • Category B - potentially adverse environmental impacts that are site specific and mostly reversible; mitigation measures already exist or can be designed with greater ease than for Category A SP & BioCF Overview - December 15, 2005

Natural HabitatsPolicy OP 4.04 • Ensure due consideration is given to the conservation of natural habitats • Safeguard their biodiversity • Ensure the sustainability of the services and products which natural habitats provide to human society • Forbids funding of projects destroying critical natural habitats SP & BioCF Overview - December 15, 2005

Forests Policy OP 4.36 • Forests are managed in a sustainable manner • Significant areas of forests are not encroached upon • The rights of forest communities to use their traditional forest areas in a sustainable manner are not compromised • Commercial logging operations are not financed by the Bank in primary tropical moist forests SP & BioCF Overview - December 15, 2005

Pest Management Policy OP 4.09 • Ensure pest management activities follow an Integrated Pest Management (IPM) approach • Minimize environmental and health hazards due to pesticide use • Develop national capacity to implement IPM-based pest management and to regulate and monitor the distribution and use of pesticides SP & BioCF Overview - December 15, 2005

Social Safeguard Policies and Instruments • OP/BP 4.12 “Involuntary Resettlement” Resettlement Plan (RP) / Resettlement Framework / Process Framework • OP 4.10 “Indigenous Peoples” Indigenous People Plan (IPP) In practice the title may vary: Vulnerable Community Development Plan (VCDP)/ Ethnic Minority Development Plan (EMDP) OP 4.10 requires social assessment and preparation of a RP in case of presence of IPs in the vicinity of the project area SP & BioCF Overview - December 15, 2005

Key Provisions • The policy affords project-affected Indigenous Peoples a stronger voice through a process of free, prior and informed consultation • “Free, prior, and informed consultation” refers to a culturally appropriate and collective decision-making process subsequent to meaningful and good faith consultation and informed participation • It does not constitute a veto right for individuals or groups SP & BioCF Overview - December 15, 2005

  14. OP 4.12: Policy Triggers A. The involuntary taking of land, resulting in: • relocation or loss of shelter; • loss of assets or access to assets; or • loss of income sources or means of livelihood, whether or not the affected persons must move to another location B. Restricting access to legally designated parks and protected areas resulting in adverse impacts on the livelihoods of the displaced (Para3) Only direct economic and social impacts resulting from “taking of land” are covered SP & BioCF Overview - December 15, 2005

Projects in DisputedAreas OP 7.60 • To ensure : • any territorial dispute affecting a project is identified at the earliest possible stage in order to preserve relations between the Bank and its member countries • preserve relations between the borrower and other clients • not to prejudice the position of either the Bank or the countries concerned SP & BioCF Overview - December 15, 2005

  16. Policy on International Waterways OP 7.50 To ensure projects will neither affect the efficient utilization and protection of international waterways, nor adversely affect relations between the Bank and its borrowers and between states SP & BioCF Overview - December 15, 2005

BioCF Specific Safeguards Issues • Generally Category B projects • Requiring an EA report needing to be disclosed in-country and at the Infoshop at least 60 days before contract • In exceptional cases, may be Category A • If land acquisition, need for Resettlement Action Plan or Framework • Possibly also Indigenous Peoples Plan SP & BioCF Overview - December 15, 2005

  18. CF Generic Issue : Supervision • Issue 1 : disbursement can be for 15-20 years, much longer than average WB loan • Issue 2 : cost and funding of supervision • Proposal: enroll the assistance of the certifiers to check on safeguards compliance. Reporting by certifiers to WB staff in cases of non-compliance and action by WB/CF staff in such cases. SP & BioCF Overview - December 15, 2005
