Background Title IX • “No person in the United States, shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving federal financial assistance” • June 23, 1972; Title IX of Educational Amendments to Civil Rights Act of 1964.

  4. Overview • Intent is to seek equity in education • Interpretation and application has been primarily in athletics although other issues can be interpreted through Title IX regulations • Credited with over 800% increase (2006) in girl’s and women’s participation in athletics in high school and college • It’s about social change- or to use the language of last week’s AHS Challenge Day- ‘getting below the waterline’ • Requires cautious review and challenges to assumptions

Meritocracy vs Victory with Honor Principles • Meritocracy values only winners • Principles of athletics competition as set out by California Interscholastic Foundation and adopted by AUSD in 2006 are about much more than winning • Athletics at its best provides young people with a values system that sustains them through life

Fundraising for sports as secondary issue for today’s discussion • Some groups have access to high dollar donors • Some groups have highly motivated and capable parent fundraisers • Result has been that some groups have raised large sums while others have not had adequate funding or facilities • As a community we have allowed this example of meritocracy to continue without review

  7. Equity and Equality • Equity means relative similarity in programming support from all funding streams • Equality means dollar for dollar matching in program funding

  8. Equity and Equality examples • Football teams have high equipment and safety costs • Cross county teams have little or no equipment and safety costs • Equity allows for football teams to have higher costs but equitable funding.

  9. Litmus Test for Equity • “An athletics program can be considered gender equitable when the participants in both men’s and women’s programs would accept as fair and equitable the overall program of the other gender” • Office of Civil Rights (OCR) Title IX Reviewer training information

Assumptions for tonight’s discussion: • Review immediate issue of spring 2008 field allocations during Cougar construction • Agree to continue dialog on broader issues of fundraising oversight and equity after immediate issue resolved • Agree to use common sense to create equitable solutions to immediate and longer term issues • We have shared commitment to principles of equity

Equitable common sense solution proposed • Recognition and acknowledgement of unequal access to fundraising between the baseball and softball teams • Recognition and acknowlegement that the baseball team will benefit from Measure A funds as early as midseason 2008 • Agreement that dislocating softball to accommodate baseball during the renovation of the baseball home field inequitable

  12. Proposal for an equitable and common sense solution • Softball stays on Memorial which is better suited for 60 foot basepaths and shallow outfield dimensions • Baseball moves to Oceanview which has the capability to handle 90 foot basepaths and has deeper outfield dimensions.

Common sense issues • Safety of tennis players at Memorial is better during softball than baseball • Baseball will benefit from Cougar construction bond funding • Softball will benefit from City of Albany Memorial Park bond funding but will still not have exclusive sport specific access because Memorial will remain a shared facility with city recreational baseball leagues

Conclusions • AUSD needs a more effective approach to assuring Title IX compliance. • Responding to complaints on a case by case basis is not adequate for Albany. • Field allocation in spring of 2008 highlights the need for an equitable approach. • Our students and our community expect a much higher standard. • We have the resources to provide it.
