Georgia Law • O.C.G.A. § 50-36-1 • State agencies providing a public benefit must require applicants ages 18 and over to: • Provide one secure and verifiable document • Execute an affidavit and provide supporting documentation, as required • Qualified Aliens/Non-immigrants must be verified through the federal SAVE program

  3. Each applicant must: • Provide a secure and verifiable document • Complete an affidavit and select a category • United States citizen • Legal permanent resident of the United States • Qualified alien or non-immigrant • Provide supporting documentation • If presenting a foreign passport • If selecting qualified alien/non-immigrant • Present the affidavit to a notary public and follow his/her instructions

  4. Secure and Verifiable Documents • Approved by the Georgia Attorney General: • U.S. Passport • State-issued Driver’s License or ID • U.S. Permanent Resident card or Alien Reg. Receipt card • Foreign Passport with I-94, I-94A, I-94W or other supporting documentation with his/her A# • Employment Authorization Document with picture • And others, as listed on page 2 • Must be current; Not expired

Not S&V documents • Not approved by the Georgia Attorney General: • Foreign Passport without supporting documentation • Consulate Card of any kind • International Driver’s License • National ID Card • Student ID or Voter ID • Driver’s License from another country, except Canada • ITIN – Individual Taxpayer Identification Number

  9. VOEPB Affidavit • Complete in Ink • Last name, first name, and age • Status • A#, if applicable • Secure and Verifiable Document • City • Signature and Printed Name of Applicant • Notarization • Document tracking

Local Program Responsibilities • Print the affidavit and the list of secure and verifiable documents in duplex format (front/back) • Distribute the affidavit to all applicants ages 18 and over at time of intake or within 30 days after a his/her 18th birthday • Provide a notary public, if able • Collect a copy of the secure and verifiable document and supporting documentation • Run GALIS report AL290 every 30 days

  11. United States Citizen • Completes the affidavit • Provides a secure and verifiable document • The information is entered in GALIS • Affidavit and copy are maintained in the student permanent record • No further action

  12. Legal Permanent Resident • Completes the affidavit • Provides a secure and verifiable document • Proof of Legal Permanent Resident status is NOT required • The information is entered in GALIS • Affidavit and copy are maintained in the student permanent record • No further action

  13. Qualified Alien/Non-immigrant • Completes the affidavit • Provides a secure and verifiable document • Provides support documentation for status • The information is entered in GALIS • Affidavit and copies are maintained in the student permanent record • Must be submitted to OAE

  14. Supporting Documentation • Federal: Homeland Security, Dept. of State • Examples include, but are not limited to: • Foreign passport with I-94, I-94A, I-94W • Employment Authorization Card (I-766, I-688A or I-688B) • Refugee Travel Document (I-571) • 797-A, which replaces an I-94

  21. Local Processing of Affidavits • Collect the notarized affidavits • Review and identify qualified alien affidavits to send to OAE • Record information in GALIS • Maintain the affidavits in the students’ permanent records

  22. Qualified Alien Affidavits Copies of the affidavit, secure and verifiable document, and supporting documentation must be submitted to OAE within 20 business days Affidavits and supporting documentation may be submitted hard copy or via fax

  23. Qualified Alien status: OAE Receives documents Reviews the affidavit, secure and verifiable document, and supporting documentation Submits the information to the federal Systematic Alien Verification for Entitlements (SAVE) program

  24. Refusal of Services and Appeal • If a student is unable to be verified: • Student and program are notified • Services must end • Student may appeal to OAE • In writing • Within 10 business days • With additional supporting documentation

Keep in Mind VOEPB Directions document is available Applicants complete the affidavit only ONE time Qualified Alien applicants w/ supporting documentation are eligible to enroll Affidavits completed in 2010 and 2011 can be used to satisfy the affidavit requirement Pull VOEPB forms forward when students attend in a new fiscal year

  26. Referral Process Work with local community agencies, organizations, and volunteer groups Develop a referral process Distribute contact information for other providers
