Right of Way Plan Developmentexemption Subdivision and Platting Act The conveyance of R/W (Fee Title) to MDT without having Certificates of Survey and Subdivision Plats of record is provided by an exemption from the “Montana Subdivision and Platting Act” (MCA 76-3-209), which excepts MDT from the surveying and platting requirements of the chapter, if such parcels are shown on highway plans of record. Quality plans with good cadastral info… Deeds, Deed Exhibits and Plans filed and recorded in Clerk and Recorder Office

Consultants to MDT • Consultants design R/W and RD plans in Every District. • MDT Helena checks all Consultant Projects prior to authorization – they should have gone through an internal check prior to submission • Opx2 has r/w activities for consultant design projects. • Identical to MDT projects

  6. Preliminary Field Review (PFR)Activity 200 • Assign Project to R/W Designer • Request Cadastral Survey (Act 805) • PFR Establishes R/W Design criteria If design is less than standard r/w width say why. • Access Control, R.R., Utility Involvement • P.E Study prepared by Field R/W Crew

  7. P.E. Study Includes: • Last Deeds of Record (Vesting Deeds) • Ownership Maps • Copies of all Plats & Subdivision adjacent • Irrigation Studies and ownerships of ditches • Access Control Studies • 4 (f) (parks, recreation or wildlife) 6 (f) land and water conservation funds used on a site • Cost Estimate and Relocation Costs • Users are: Designers, Agents, Environmental, Public Information Office, Hydraulics, Surveyors

  8. Receipt of Preliminary CADD Files from Rd Dgn (Act. 212) • Create R/W CADD Files • Design work charged to 9102 – P.E. • See R/W Design Manual for instructions

  9. Receipt of Cadastral Survey (Act. 510) • Plot Ex. R/W (Act 818) using Retracement Survey • Utilize all deeds and prior right of way plans in addition to the recorded COS provided by MDT Survey or Consultant. • Caveat to all Surveyors and Designers: Read those deeds – Pull old R/W plans and as-built plans • Place Section Corners - Section Breakdown of interior lines (proportion found to record distances.)

  10. RECEIPT of P.E. STUDY • Plot location of property lines - using last deeds of record and subdivision plats – • State Plane Coordinate System - If distances are ground – apply the CSF factor to convert to grid. Rotate existing COS to grid coordinate system. • Give Parcel No’s to ownerships – label aliquot parts • Along with placement of ex. r/w – most challenging element of r/w design

Right of Way Designer needs to know: Read & Write property descriptions Different types of Easements How to read a centerline description Understand the subdivision of sections Know the Aliquot parts of a section Interpret a metes and bounds description Recognize Gaps, Overlaps & Conflicts in ownership descriptions Micro-station Proficient

  12. ALIGNMENT & GRADE (Act. 216 ) • Design new right of way. Design Criteria) • 80 feet or 3 m beyond const. limits (primary) • 65 feet or 3 m beyond const. limits (secondary) • Order Title Commitments. Review Commitments for easements and leases. • Incorporate Access control into plans when applicable. Calculate Areas. • Develop preliminary R/W plans to submit for Plan-in-Hand (Act 806)

  13. Receipt of Final Const. LimitsAct. 224after P.I.H. • Make changes to the preliminary R/W plans • Check for wetland mitigation – changes in irrigation or drainage pipes • Finalize plans • Submit plans for checking – prior to authorization.

  14. Project must be in the STIP (State Transportation Improvement Program)Request FHWA Approval & Programming(include all known costsrelocation – irrigation- land

  15. Authorize for Acquisition • Distribute Plans, Deeds & Exhibits • Plans and Route Description to Clerk & Recorder • Notarized receipt that County is in possession of plans • Any further changes to R/W plans will be charged to 9202 – R/W.

  16. R/W Plan Revisions Blue Sheet process Reduction in R/W Widths should go through a District Red Line Process – Why? Steve will tell you. Exception to the uniform r/w width policy if less then minimum standards Revised Plans sent to County Clerk and Recorder – notarized receipt returned
