  1. The LW403 Evening Lecture: A Debate! The MG(Ret.) Michael J. Nardotti, Jr. Lecture offered as part of the Salvatore Constitutional & Military Law Lecture Series 14 November 2013, 1930hrs Arnold Auditorium, Mahan Hall, West Point, NY Issue: Whether the legislative prayer practice that opens the Greece, NY, monthly town council meetings violates the Establishment Clause of the First Amendment. Johnson, Jr. For Respondent, Town of Greece, NY Please join the Department of Law and Cadets enrolled in LW403, Constitutional & Military Law, for an evening of spirited constitutional debate between attorneys Mr.Gregory Lipper and Mr.Thomas Johnson over the interpretation of the Establishment Clause, specifically, the extent to which the Lemon standard should control the analysis of a legislative prayer-practice raised in the case of Galloway v. the City of Greece. The U.S . Supreme Court granted certiorari and scheduled oral argument for 6 November 2013.Our debate will occur just eight days after oral argument in the case is presented to the Court. Our debate moderator, LTG (Ret.) Dana K. Chipman, USMA 1980, was commissioned as an Infantry officer, attended Stanford Law School on a Fully-Funded Legal Education (FLEP) scholarship and joined the Judge Advocate General’s Corps. His distinguished military career culminated in his selection as The Judge Advocate General of the United States Army. After 37 years of dedicated service, LTG Chipman retired in August 2013. Gregory M. Lipper, is a Senior Litigation Counsel at Americans United for Separation of Church and State. He joined Americans United in 2011 and litigates church/state cases at both the trial and appellate levels. An experienced appellate advocate, he has authored over twenty briefs in cases pending before the Supreme Court. Mr. Lipper received his law degree, magna cum laude, from Harvard Law School and clerked for Judge R. Guy Cole, Jr. on the Court of Appeals for the Sixth Circuit. Thomas M. Johnson Jr. isan associate in the Washington, D.C. law firm of Gibson, Dunn & Crutcher. He practices in the firm’s Litigation Department and is a member of its Constitutional Law practice group. Upon receiving his law degree, magna cum laude, from Harvard Law School, Mr. Johnson clerked for Judge Jerry E. Smith on the Court of Appeals for the Fifth Circuit. Seating: Cadets taking LW403 will have designated seating. Other special guests may sit in any open seating area in the back and side of Arnold Auditorium.
