  2. Losing Your Driving Privilege • Driving is a privilege, not a right • Traffic Violations- 12 to 14 points in more than two years. • Reasons to lose your license • Failure to appear in court • Failure to pay surcharges • at fault in a fatal accident

  4. Mandatory Sentences – DUI (Underage) • BAC- above .08 • 7 mo to a year suspension • 12-48 hr in an IDRC, $230/day fee • Up to 30 days imprisonment • $100 Drunk driving fund fee • $1,000 annual surcharge for 3 years

  5. 1st Offense Underage (but less than .08) See p. 115 • 30 – 90 day suspension of license • 15-30 days community service • Participation in IDRC

  6. Mandatory Sentence DUI • 3 mo suspension • $250-400 fine • 12-48hrs in IDRC, $75/day fee • Up to 30 days imprisonment • $100 DD fund fee • $1,000 surcharge for three years

  7. Cont… • $75 Safe Neighborhood Service Fund Fee • Possible interlock device requirement for 6 months to 1 year

  8. Mandatory Sentences w/ Imprisonment • Alcohol or drug related: • 1st offense – up to 30 days • 2nd offense – 48 hrs to 90 days • 3rd offense w/in 10 yrs of 2nd – 180 days • Driving on DUI suspension – 10 to 90 days • Driving w/ no insurance (2nd offense) – 14 days

  9. III. Other Violations • Not telling the truth when applying for a license or registration: $200-$500 fine, up to 6 mo. In jail, 6 mo to 2 yr suspension. • Loan a license to another driver- $25-$100 fine and suspension of license

  10. Have another person take the test for you: $200-$500 fine, and/or 30-90 days imprisonment and you may have your license revoked. • Fail to pay 6 months of child support or provide healthcare; license will be suspended until support is paid.

  11. IV. Breath Tests Implied Consent Law: • If asked to take a breath test you must comply. • Refusal – 6 mo suspension, $250 - $500 Fine & IDRC • $1,000 surcharge for 3 years

  12. Intoxicated Driver Resource Ctr. • Any person convicted of an alcohol related traffic offense must be detained here • The program evaluates for and alcohol or drug problem • Failure to comply will result in further license suspension and possible jail time

  13. The Point System p.126 • MV keeps track of your driving record by adding points every time you’re convicted of a moving violation • Violation in another state will be added to your license • Up to 3 pts will be subtracted from pt total for every year driver goes w/o a violation or suspension

  14. Restoring Your LicenseDriver Improvement Program • After completing the Driver Improvement program you are on probation for a year; any violation during that year will result in a suspension once again • Required to attend if accumulate 12-14 points in 24 month period

  15. Surcharges and Point Violations • Drivers who accumulate 6 or more pts in a period of 3 yrs or less are subject to a surcharge of $150 for six pts and $25 for each additional pt • Drivers must pay the surcharge each year for 3 years

  16. Defensive Driving Course • 2 pts will be removed from accumulated pts • May qualify for insurance rate reduction • Can only do this once every 5 yrs
