Quote from Title IX of the Education Amendments of 1972

  3. Title IX • Title IX of the Education Amendments of 1972, more commonly known simply as Title IX, was legislation enacted to create gender equality in several different areas of education activities, one of which being athletic opportunities at universities that receive federal financial assistance

  4. Background/History • It can be argued that since the beginning of societies women have been discriminated against • Historically women have been the underrepresented gender in collegiate athletics • Inspired by the Civil Rights Act of 1964 • Two key movements lead to its creation • Suffrage movement • Women’s Liberation movement • In existence for nearly 38 years • Law addressed 10 key areas for equality in educational programming

Current Three Prong Test of Compliance • All university athletic departments must meet one of the three prongs: • Prong One – Provide athletic participation opportunities that are substantially proportionate to the student enrollment OR • Prong Two - Demonstrate a continual expansion of athletic opportunities for the underrepresented sex OR • Prong Three - Fully and effectively accommodate the interests and abilities of the underrepresented sex.

Why Title IX is Ineffective • Forces universities to reduce opportunities for males (and in some cases females as well) • Creates women’s teams without the male equivalent • Forces athletic departments to create women’s teams that are of little or no interest to the university undergraduate female population • Allows the addition of “fake” spots on women’s teams solely to meet compliance • Creates blatant reverse discrimination

What Opponents Will Say • Title IX has created millions of athletic opportunities for females since 1972 • More opportunities are created for females than our taken away from males • Females are still facing discrimination in collegiate athletics • If men’s teams spent less money ( football and basketball) then there would be more money for more teams

  8. In conclusion: All of these reasons previously stated are why I honestly believe that Title IX is ineffective today and needs reform. When we reduce student-athletes to mere numbers in hopes of creating a perfect politically correct equation, we lose sight of what collegiate athletics is truly all about. - Undeniable Talent - Hard Work - Perseverance - Sport Intelligence - Competitiveness

  9. One final question to ask yourselves? Can you truly support a law that would give your daughter a future collegiate athletic opportunity if that same law cost your son his?

Comm 170 Group Proposed Law Our new law would require intercollegiate institutions, which receive federal funding, to commit to providing and advancing athletic opportunities, athletic teams, athletic facilities, and scholarship dollars for both men AND women. Our new 3 Prong Test- Institutions must meet all 3 prongs • Prong 1: All institutions must show a continuing practice of expanding athletic opportunities for both men AND women • Prong 2: All institutions must measure specific athletic opportunities by number of teams NOT BY number of student-athletes • This would ensure that the large participant numbers of revenue earning football teams would not negatively effect overall numbers of male student-athletes at an institution • Prong 3 : All institutions participation interest scores, from a developed special choice model for discovering latent dimensionality of interest in collegiate athletic participation, must be equal to opportunities their institutions provides. • Referring to Dr. Wayne DeSarbo’s presentation • An athletic participation interest model would be developed so that each institution could input their statistics and then an overall interest scale could be made. The goal would be for universities to have their participation levels meet their scored interest levels Our new law would end the reverse discrimination that Title IX promotes and ensure better opportunities for ALL!
