  11. Authority to Construct Sewers • . . . the Sewer District under Ch. 204, RSMo 2000, has the power and authority to establish, construct, reconstruct, improve, repair, operate, and maintain sanitary sewer systems and treatment facilities in Platte County, Missouri. Parameters of Contract

Authority to Enter into Intergovernmental Cooperative Agreements • Sec. 70.220, RSMo, 2000, as amended, authorizes political subdivisions such as the Sewer District and the School District to enter into intergovernmental cooperative agreements for the planning, development, construction, acquisition, or operation of any public improvement or facility provided the subject and purposes of such an agreement or cooperative action are within the scope and powers of each such political subdivision; Parameters of Contract

Acquisition of Land • The School District will acquire at its sole cost all lands necessary for the construction, operation, and maintenance of the improvements. • The School District will be responsible for all negotiations with property owners for acquisition of the lands, including the costs of condemnation proceedings if necessary. • In the event that condemnation is necessary, such condemnation proceedings will be conducted and controlled by and in the name of the Sewer District. . . Construction • The School District at its cost shall undertake construction of the project • The final design, plans, specifications, cost estimates, and completed construction of and for the project shall meet all standards and comply with all review and approval procedures of the sewer district as provided for in its rules and regulations • The School District will own all improvements and the lands for the project until final inspection and acceptance of the improvements and lands by the Sewer District.   15. Conveyance • Upon project completion, the School District shall convey the lands and improvements to the Sewer District and the Sewer District shall accept the improvements and lands. • Upon such conveyance and thereafter, the Sewer District at its sole cost and expense shall be responsible for operating, maintaining, repairing, and replacing as necessary the improvements and otherwise tending to the lands.   16. Payback • Construction of the improvements and acquisition of the Lands shall be paid for by the School District, with reimbursement to the School District by the Sewer District from the proceeds of connection fees over a period of up to twenty (20) years or until the school district is reimbursed the total project cost with accumulated interest.
