  2. 2002 Report to Congress on the Voluntary National Guidelines • Compliance w/ reporting requirement = 30% • 87% followed guidelines • 5% no BWE due to Safety Concern • Most non exchange due to route constraints • Secretary’s Determination: • Make voluntary program mandatory • Implement penalties

Coast Guard Regulationsin Progress • Penalties for failing to report BWM practices • Proposed Rule published January 6, 2003 • Final Rule in draft • Mandatory Ballast Water Management • Proposed Rule published July 30, 2003 • 1st USCG Environmental Regulation under DHS? • BW discharge standard • Advanced Notice of Proposed Rulemaking published March 4, 2002 • Proposed Rule in development within USCG • Environmental Impact Statement Scoping Fall 2003

Overview of National Mandatory BWM Program • Who: All vessels inbound from outside EEZ • What: BWM plan and BWM—4 options • Exchange—empty/refill or 3X flow-through • Retain • Offload to approved facility • Treatment with approved system • When: • 200 NM from any land • Safe for ship & crew & no detour or delay
