Legalobligation The Central Government amended the Sugarcane (Control) Order, 1966 vide notification dated 10th November, 2006 under the title “the Sugarcane (Control) (Amendment) Order, 2006” with a view, inter alia, to put restriction on setting up of two sugar factories within the radius of 15 Kms. In response to the above notification entrepreneurs wish to set up sugar mill require to obtain a distancecertificatefrom the Cane Commissioner/Director of Sugar certifying that the distance between the proposed sugar mill and any existing sugar factory or another new sugar factory in a State or two or more States. After obtaining the distance certificate, the concerned person shall file the Industrial Entrepreneur Memorandum (IEM) with the Central Government within one month of issue of such certificate failing which validity of certificate shall expire. After filing the IEM, the concerned person shall submit a performance guarantee of rupees one crore to Chief Director (Sugar) within thirty days of filing the IEM as a surety for implementing the IEM within the stipulated time of two years or extended time as specified in Clause 6C failing which IEM shall stand de-recognized as far as provision of the Order are concerned.
