  1. PUBLIC COMMENT PERIOD If you would like to address the Mayor and City Council during the Public Comment section on Tonight’s Agenda, please record your name and address on the sign-up sheet located at the table on the side of the Council room. Please note that public comments are limited to five (5) minutes per speaker.

  2. Certificates, Awards and Presentations • Presentation of the Healthy Community Challenge 2012 Award to the Cumberland Team from Barry Ronan, CEO of the Western Maryland Health System.

  3. Director’s Report • Police Department monthly report for June, 2012. • Utilities Division monthly report for June 2012.

  4. Approval of Minutes • Approval of the regular session minutes of May 22, 2012. • Approval of the minutes of the closed administrative sessions of May 8 and May 15, 2012.

  6. Ordinances • Ordinance (1st reading) - enacting Section 11-2 of the Code to regulate the use of bicycle storage lockers to preclude unintended and improper use of the lockers.

  7. Bicycle Storage Regulations • Recommended by Bicycle Advisory Commission • Limits use to storage of bicycles, bicycle accessory equipment and bicyclists’ carry-on luggage • Sets use period from 8:00 AM to 9:00 PM • Authorized CPD to remove non-compliant items

Ordinances • Ordinance (1st reading) - to repeal and reenact certain sections of the Housing Code to address issues pertaining to state lead paint laws, rental unit inspections, landlord/tenant communication, increased fees for late rental registration, and un-mandating landlord course training.

  11. Housing Code Revisions • Reverts back to required City inspections based on change in occupancy. • Adds increasing fee schedule for unpaid licenses. • Except for imminent dangers, requires written notice of non-compliant conditions 10-days prior to formal complaint. • Corrects typographical and grammatical errors.

  12. Ordinances • Ordinance (1st reading) - to provide for the regulation of planting and locating ornamental grasses and bamboo.

Ornamental Grasses and Bamboo • Limits growth area to defined garden or landscaping areas by requiring installation of appropriate growth barriers • Prohibits growth or spread onto adjoining properties • Restricts such plantings from minimum setback areas as defined by the City Zoning Ordinance

  14. Resolutions • Resolution supporting the Allegany College of Maryland Foundation's application to the MD Department of Housing and Community Development for tax credits to support the provision of scholarships and tuition assistance to financially deserving students.

Resolutions • Resolution authorizing the issuance and sale of a General Obligation Installment Bond entitled, "Mayor and City Council of Cumberland Water Quality Bond, Series 2012," in the principal amount of $152,000 to be used for the public purpose of financing or reimbursing costs associated with the planning and design of a combined sewage overflow facility near the WWTP, and providing for related costs, terms, and disbursement of the bond.

  18. Orders • Order authorizing the execution of an Employment Agreement with Eugene M. Kight for the position of Code Enforcement Officer in the Special Taxing District for the period July 13, 2012 - July 13, 2013.

  19. Orders • Order authorizing the Chief of Police to accept a Governor's Office of Crime Control and Prevention Grant, entitled "Monitoring Support," in the amount of $20,470 to be used for police overtime to monitor sex offender compliance.

Orders • Order authorizing the Chief of Police to accept a Governor's Office of Crime Control and Prevention grant, entitled "Safe Streets," in the amount of $180,000 to be used for police overtime, equipment, and temporary support positions to be used in a multi-agency effort to identify and apprehend offenders.

  21. Orders • Order authorizing the Chief of Police to accept a Governor's Office of Crime Control and Prevention grant entitled "Overtime Support," in the amount of $10,000 to be used for police overtime targeted towards gun violence reduction.

Letters, Petitions • Letter from Greg Gossard, Principal, The Hampstead Companies, requesting a Payment in Lieu of Taxes for property tax reduction for Old Towne Manor located on East Oldtown Road. Hampstead intends to undertake rehabilitation of the property resulting in approximately $4,400,000 of construction costs and is requesting an annual tax reduction of $100/unit for a term of 42 years.
