  3. 2007 Legislative Wrap Up • VAGP tracked about 35 relevant bills in 2007 • 8 bills were deemed high priority to VAGP • VAGP opposed all but one of those

  4. VAGP High Priority Legislation • Opposed by VAGP • HB 1917 (J. Ward)/SB 861 (Reynolds) Requires disclosure of the location where services will be performed under a contract (Failed) • HB 2137 (Cline) Requires DGS, VITA and SCHEV to report procurements for items/contracts listed on the Commonwealth Competition Council's commercial activities list (Passed) • HB 2433 (Albo) Requires interim or comprehensive agreements under the Public-Private Transportation Act to be competitively bid if the total cost of the project involves the expenditure of  $10 million or more in state funds (Failed) • HB 2448 (Frederick) Requires that a jailer shall reasonably attempt to verify the citizen status of certain persons who are confined in jail (Failed)

Opposed by VAGP (continued) • HB 2826 (Gilbert) Requires all public bodies and contractors who intend to contract with public bodies to register and participate in a federal work authorization program to verify information on all new employees (Failed) • SB 756 (Stosch) Establishes the Public-Private Partnership Advisory Commission to review and advise responsible public entities that are agencies or institutions of the Commonwealth on detailed proposals for qualifying projects under the Public-Private Education Facilities and Infrastructure Act of 2002 (Passed) • SB 1002 (Houck)Allows memoranda, staff evaluations, or other records prepared by the responsible public entity, its staff, outside advisors, or consultants exclusively for the evaluation and negotiation of proposals filed under the PPTA and PPEA to be withheld from public disclosure (Passed)

Other Procurement Legislation • HB 1707 (Lingamfelter) Provides that as a condition of awarding a contract for the provision of services that require the contractor or his employees to have direct contact with students on school property during regular school hours, the school board must require the contractor to provide certification that all employees who will have direct contact with students have not been convicted of a felony or any offense involving the sexual molestation or physical or sexual abuse or rape of a child (Passed) • HB 2485 (Bulova) Provides for the consideration of environmentally preferable products in the procurement of goods and services by state and local agencies • SB 1408 (Hanger) Requires the Commonwealth Competition Council to review the procurement process under the Public-Private Transportation and the Public-Private Education Facilities and Infrastructure Acts (Passed)
