Key Results Post-Petten ExCo Meeting • Hagen takes initiative to prepare proposal for collaboration with IPHE on IEA HIA Task 22 • Clear implementation proposal from strategic level • Based on IPHE “Collaboration Group” vehicle • Would allow 18 month window for non-IEA HIA members to join implementing agreement • IEA Legal Office reviews proposal • IPHE has no contractual capacity and cannot join IEA HIA; also concern with IPHE voting block • IEA has no observer policy • Non-IEA HIA members can join individually • MOU could be signed by respective Chairs AN IMPLEMENTING AGREEMENT OF THE INTERNATIONAL ENERGY AGENCY

Key Results Post-Petten ExCo Meeting • Other Reactions to initial proposal • IPHE representative from DOE Hydrogen Program prefers simpler approach (less bureaucratic and resource intensive) without collaboration group • NEDO prefers standard membership approach • IPHE Secretariat suggests return to IEA HIA’s original collaboration proposal AN IMPLEMENTING AGREEMENT OF THE INTERNATIONAL ENERGY AGENCY

Key Results Post-Petten ExCo Meeting • IEA Legal Office review of revised proposal • Presuming ExCo approval… • High level MOU with Annexes 1(as opposed to use of “Collaboration Group”) for specific provisions: Task 22 would be Annex “1” • With extension of membership invitations to non-IEA HIA members and evidence of their good faith intent to complete membership application within short, well-defined (18 month) period • No voting rights during 18 month period AN IMPLEMENTING AGREEMENT OF THE INTERNATIONAL ENERGY AGENCY

Post Petten Meeting – Summer –Fall 2007 • ILC considers prospect of MOU at June 2007 meeting in Korea • Legal Office reviews and revises MOU and Annex for compatibility with IEA format • ILC reviews revised proposal via IPHE Secretariat • No suggestions/requests for change • India and China express support for MOU • No response from Russia and Brazil • IEA HIA ExCo receives same proposal AN IMPLEMENTING AGREEMENT OF THE INTERNATIONAL ENERGY AGENCY

  7. Action Going Forward • ExCo asked to consider and approve proposed MOU and Annex on Task 22 • Assuming approval, IPHE Steering Committee will be asked to approve MOU and Task 22 Annex next week in Rome • If approved, IEA HIA Secretariat will furnish exemplar letter of intent to join IEAHIA and participate in Task 22i same proposal AN IMPLEMENTING AGREEMENT OF THE INTERNATIONAL ENERGY AGENCY
