  1. Take out a piece of paper + respond: • A 38 year old woman is in her garage doing laundry. Suddenly, she is struck on her head with a baseball bat, killing her instantly! If caught, what should happen to the killer? • Suppose that the killer was her 15 year old son. Would the fact that he is a minor change anything about his punishment? • ??? Jot down an unanswered question. Then, share with your partner.

This will also be part of your packet called “Juvenile Justice” (staple 5 pages together by tomorrow). • Topic: If you committed a crime, do you think it would be fair for you to be punished the same way as an adult who committed the same crime?

  4. Notes: Key Concepts & Legal Terms • Homicideis the killing of one person by another, either intentionally or unintentionally. Homicide includes accidents and murder. 2. Murderis killing someone with malice of forethought. It could be done while committing another crime.

  5. Key Concepts & Legal Terms 3. First-degree murderis killing a person with malice of forethought; the killing was planned. It was deliberately done. 4. Second-degree murderis a killing done during a crime deemed dangerous to human life (like driving drunk). The crime was most likely not committed with the intention of killing.

  6. 5. Voluntary manslaughteris killing someone intentionally but without malice of forethought. For example, if the killing was a crime of passion (such as killing a spouse because of jealousy), the intention was to kill. However, there was no malice of forethought because it was not planned. 6. Involuntary manslaughteris killing someone unlawfully but without malice of forethought. It was committed without intent to kill and without a conscious disregard for human life (such as a traffic accident).
