2. New Licensing Regulations • The Dietetics Licensing Board was created during the 2011 legislative session by the passage of Enrolled Act #74. • This established Wyoming Statutes 33-47-101 through 33-47-110. • This law provides for the licensure and regulation of the practice of dietetics.

5. The Board’s Authority The Dietetics Licensing Board is empowered to provide for the licensure and regulation of dietitian’s practicing in Wyoming.

6. The Board’s Mission The Board is legislatively mandated to safeguard the health, safety, and welfare of the citizens of Wyoming by ensuring that those individuals licensed to provide dietetic services in this state are appropriately qualified and that they practice in accordance with the statute, rules, and regulations, and codes of ethics for the profession.

7. The Rules & Regulations… • The Board has been working on drafting and adopting rules and regulations. • The rules were filed as “Emergency” rules effective March 1, 2012. • As Emergency rules, they are in effect for 120 days • The Board is proceeding with the regular rule making procedure to formally adopt these “Emergency” rules as regular rules. • What this means: The current rules are in effect until June 28,2012 or until the Board has formally adopted the regular rules and they have been filed with the Secretary of State- whichever comes first.

8. Who Must Be Licensed or Certified? • Wyoming is a Practice Act and Title Protection State. • This means that persons must be licensed by the Board in order to provide the services defined in the statute and rules and regulations. • It also means that only persons licensed by the Board may identify themselves as a Licensed Dietitian.

9. Dietitian Practice Defined CHAPTER 3 (of Rules/Regulations) DIETETICS LICENSURE Section 1. The Practice of a Dietitian. The practice of a Dietitian consists of the integration and application of principles derived from the sciences of food, nutrition, management, communication, and biological, physiological, behavioral, and social sciences to achieve and maintain optimal human health. It includes the nutrition care process and medical nutrition therapy, but does not include medical differential diagnosis of the health status of an individual

10. Exempted Individuals • May practice the professions regulated without holding a license issued by the Board: • A qualified member of a legally recognized profession who is otherwise licensed or certified by this state, while performing services consistent with the license ore certification, provided the member does not purport to be practicing dietetics and does not claim to be a dietitian. • A student enrolled in an accredited program in dietetics while engaged as part of the program in the practice of dietetics under the supervision of a licensed dietitian. • A dietitian who is serving in the armed forces or the public health service of the United States, who is employed by the veterans administration or a Wyoming department of health nutritional services program under the supervision of licensed dietitian, while engaged in the practice of dietetics provided the practice is related to that service or employment. • A person employed by a school district who is responsible for menu planning, purchasing food, meal preparation or food safety, who uses general nonmedical nutrition information in the performance of the person’s duties and who does not purport to be practicing dietetics and does not claim to be a dietitian.

11. Exempted Individuals (Continued)… • A retailer who furnishes oral or written general nonmedical nutrition information related to food, food materials or dietary supplements or the marketing of food, food materials or dietary supplements. • A person who is employed as an instructor at a United States regionally accredited college or university with a major course of study in human nutrition, nutrition education, public health nutrition, food and nutrition, dietetics or food systems management or an equivalent major course of study as approved by the board. • A person providing weight control services. • A nonresident registered dietitian licensed in another state if the requirements for licensure are at least as stringent as the requirements for licensure contained in this act, or registered by the commission if the state of residence does not require licensure, while practicing dietetics in this state for up to twenty days annually. • A person offering general nonmedical nutritional information, either as part of the sales of nutritional products or independently, who does not represent that they are a licensed dietitian.

12. “It’s Time To Get Licensed” • Get Started Today! • By July 1, 2012 – All Registered Dietitians practicing in Wyoming need to be licensed (unless qualifying under one of the exemptions). • Please help spread the word if you are working with dietitians who are not present today . • The Board will be posting this presentation on the licensing board website. • The Board will be posting information on the Wyoming Dietetic Association website. • A notice will be sent out to RD’s in the State of Wyoming • The WDA distribution list will be utilized as well.

14. General Information • In compliance with U.S. Code Title 8, Chapter 14, Section 1621, the Board must collect proof of U.S. citizenship, or proof of legal presence in the U.S. This proof is required only once for each U.S. citizen. Those with alien status will be required to submit proof with every renewal. • In most cases it is easiest for you to provide us with a copy of your birth certificate, copy of your social security card or a copy of your passport. Just one (1) form of identification is required. A copy of your driver's license is not acceptable. If you cannot provide any of these items, please refer to list A and B.

15. General Information (Continued…) • The Board cannot review your qualifications without receipt of an application and fee. • The application fee for licensure is $200.00. Make checks payable to the "State of Wyoming". Do not send cash. All fees are non-refundable regardless of the outcome. • The fee was determined based on the budget and anticipated number of dietitian’s applying for licensure in Wyoming. • The license is for a 2 year period. • Every effort will be made to review your application within two (2) to five (5) business days of completion. • CDR stands for Commission on Dietetic Registration

16. License Requirements • To qualify for licensure as a Licensed Dietitian (L.D.) in Wyoming you must meet the following requirements: • Be at least eighteen (18) years of age, and • Be a legal inhabitant of the United States, and • Have no felony convictions, and no misdemeanor convictions that relate adversely to the practice of dietetics, or the ability to practice dietetics, and

License Requirements (Continued)… • Have received a baccalaureate or post baccalaureate degree from a CADE accredited college or university with a major course of study in human nutrition, nutrition education, public health nutrition, food and nutrition, dietetics, food systems management or an equivalent major course of study as approved by the board, and • Have completed a documented supervised pre-professional practice experience component in dietetics of not less than nine hundred (900) hours under the supervision of a registered dietitian, a licensed dietitian or an individual with a doctoral degree conferred by a United States regionally accredited college or university with a major course of study in human nutrition, nutrition education, food and nutrition, dietetics or food systems management; and • Have passed the CDR exam

18. License Application Procedures • Complete the application in its entirety. Make sure that you provide a written explanation if you answered "YES" to any of questions 13 through 21. If more space is needed, attach additional sheets of paper. You must include copies of all legal documents. Read the "Warning" and "Agreement and Affidavit", print the form, and then sign and date the application, preferably with blue ink. The Board is not able to accept electronic signatures and payment at this time. • Request that the CDR send the Board an official verification of your credential. CDR's website states: "To request written verification of your registered/certified status, submit your request with your name, registration number, and address by e-mail at cdr@eatright.org or phone at 312-899-0040 Ext. 5500." The CDR verification must be sent directly to the Board office. It can be sent via email to emily.cronbaugh@wyo.gov, via fax to (307) 777-3508 or via mail to the Board at the address provided below. • Mail the complete application (3 pages), proof of U.S. citizenship or legal presence in the United States, and the $200.00 application fee, to the Board at the address provided below.

Process If you have provided a valid e-mail address on your application, you will receive a confirmation message when your application, proof of U.S. citizenship or legal presence in the United States, and fee are received. When verification is received from the CDR, your application will be reviewed for license approval. If your application is approved you will receive a wall certificate, pocket identification card, and receipt.

23. Renewal Process • Section 1. Biennial Renewal. • (a) Licenses may be renewed every two (2) years by providing the Board with • the following no later than fifteen (15) days prior to the license expiration date: • (i) Payment of the renewal fee; • (ii) Complete application for renewal; and • (iii) Proof of compliance with the continuing professional education • (CPE) requirements set out below. • (b) Each licensee shall earn a minimum of thirty (30) contact hours of CPE during each two (2) year renewal period.
