Common Themes • States should not be required to solve problems that are not reasonably controllable or preventable. • This is what the underlying statute says • This is the litmus test • The most efficient way to solve many of the implementation issues is to revise the regulation. • Guidance to work around a flawed regulation is an inefficient and potentially risky strategy

  4. Status • I really don’t know what the status is, but this is what I’ve heard: • Expect high wind guidance proposal sometime this month • Do NOT expect draft guidance on fire-related exceptional events until the end of the year
