The Americans with Disabilities Act (ADA) of 1990 • The Americans with Disabilities Act (ADA) of 1990 • A comprehensive civil rights law. • Requires complementary Paratransit transportation services to individuals who because of a disability are unable to use the fixed-route bus service.   • The ADA federal regulations establish strict criteria regarding eligibility, service characteristics, and minimum delivery standards. • Florida Commission for the Transportation Disadvantaged • In 1989, Chapter 427, Florida Statutes, created a coordinated system of transportation disadvantaged services in the state of Florida.  • Transportation funded by the Florida Commission for the Transportation Disadvantaged (FCTD) Trust Fund provides trips for “persons who by age, or disability, or economic status...” are considered to be transportation disadvantaged.  • The Board of County Commissioners, in its role as the Community Transportation Coordinator (CTC) for Broward County, serves the needs of persons who are transportation disadvantaged.

  10. Proposed Corrective Actions 1. Modify current No-Show Policy to include non-payment of fares • Based on guidance from FTA • Notify via letter to all TOPS customers informing of policy change that non-payment of fares will constitute a no-show. • 4 occurrences in a 30-day period will trigger a letter to customer with notice of service suspension at a future date, subject to appeal process. • Suspension period will be progressive: a week, then 2 weeks, etc…

Proposed Corrective Actions 2.Modify current appeals process • County resolution 1997 0128 created a 5- member volunteer board • Resolution 2002 379 increased to 7- member board. • Recommend for fare “no-shows”; change County Resolution to the use of Hearing officer (estimated $10-20K per year.)

  12. Proposed Corrective Actions 3. Procure Cashless Fare module from Stratagen • May utilize federal funds to procure-- estimated cost = $194,000 • Creates online account for customers to add value for future service. • Integrates directly with ADEPT Scheduling/ Reservation software to verify available funds prior to trip reservation. • Would replace the need for cash on board vehicle.
