PROPOSED RIGHT OF WAY DESIGN • 3106.5 Determining Types of Right of Way Parcel Takes • Fee vs. Standard Highway Easement consider: • Existing Right of Way Type of Title • Most beneficial to owner (ODOT or Property) • Property owner conflicts in the area • Type of development in the area: • Residential vs Commercial vs Industrial • Encroachments • Right of Way funding type (Federal/State/LPA) • Mood of property owners being effected • Ownership of PRO (present road occupied)
