  1. What is the lawsuit about? What is a Modchip? A modchip is a device that can modify a computers protection software. In this case OzModChip’smodchip The “PS Jailbreak”enables homebrew(user created programs) and backing up of games on the playstation 3. Sony has filed a lawsuit against OzModChips.com due to them creating a modchip (thumbdrive) that jailbreaks the Playstation 3 gaming system. Sony believes this will bring illegal back ups of games. Sony vs. OzModchips What is happening during this lawsuit? What are Sony’s Arguments? What are Oz’s Arguments? Sony had a temporary injunction on the all modchips. Meaning they can stop all modchip retailers from selling modchips until a certain date. Afterwards sony must return all the modchips if the lawsuit fails. • Sony argues that it’s illegal to backup games regardless of the manufacture’s country’s law. If the company sells the product internationally they should have to follow the laws of the country to which they are selling. • OzModChips argues that they have the right to create a product that can make a system more user customizable. Homebrewing is not illegal and it’s not their fault if someone abuses their product. If a user buys a Playstation 3 it’s their right to do whatever they want with it.
