Background • The CEC established a trinational Chemical Inventory Team to work with Mexico in constructing its National Chemicals Inventory. • This activity aligns with the objectives of: • developing tools that facilitate the tracking of chemicals between the North American countries • developing information within the North American region that is comparable and compatible

Identification and analysis of the federal legal framework for chemicals management as a basis for developing a chemicals inventory in Mexico • The report contains the description and analysis of the legal instruments related to chemicals management in Mexico. The analysis highlighted the lack of legal foundations to create a chemical inventory and propose three scenarios to fill the gaps in the legislation: • Create a General Law for Chemicals Management • Modify the General Law of the Ecological Balance and Environmental Protection • Modify the internal regulation of the Intersecretarial Commission for Controlling the Process and Use of Pesticides, Fertilizers and Toxic Substances

Development of an information system for the National Chemicals Inventory for managing data of interest from industries under state jurisdiction • The aim of this project was to develop an information system for administration and presentation of data reported by industry under state jurisdiction through the local Annual Report of Operations (COA) for subsequent integration into the National Chemicals Inventory.

Selection of sources of information for improving the quality of data for the Mexican National Chemicals Inventory • The aim of this project was to select viable information sources for compiling data on imports of chemicals and promoting improvement in the quality of data to be incorporated in the National Chemicals Inventory. • The different public databases were reviewed and meetings were held with representatives of different government entities: • Customs • INEGI • PEMEX • Ministry of Economy • Bank of Mexico • As result, the Customs database was found to be the most useful source of information since it contains data from all the import transactions by means of the “Motion document” that comes with the merchandise.

Development of policy options to assure the sustainability of the Mexican National Chemicals Inventory • The aim of this project was to validate the chemical identity of 1250 chemical substances listed in the Mexican National Chemicals Inventory that are not included in the TSCA inventory and the DSL in order to confirm their proper chemical identity and assure compatibility with the inventories of Canada and US.

Development of policy options to assure the the sustainability of the Mexican National Chemicals Inventory • The aim of this project is to analyze the different policy options for assuring sustainability of the Mexican National Chemicals Inventory through a legal analysis of obstacles and opportunities to support an intergovernmental group in taking decisions on how to proceed in creating a register of chemical substances. • The main options analyzed in the project include: • Analysis of policy risks from different alternatives • Ad hoc Group to analyze and decide on implementation • Changes in national laws and regulations • Creation of an specific organization to maintain the national registry of chemical substances

  26. Review of information on the production of chemical substances from official records in Mexico •  79% of the registries could not be used, since mixtures, minerals, inks, packaging material, and generic names are used in the sources of information • 21% (21,307) of the registries could be matched to a chemical • The main results are: • 1,500 chemicals from the raw materials section of COA (962 included in the INSQ) • 291 chemicals from the products section of COA (100% matched with the INSQ) • 399 chemicals from PROFEPA (294 included in the INSQ) • 9 chemicals from the PEMEX Annual Report 2010 • 13 chemicals from INEGI 

  27. Other advances • Intersectoral meetings between government agencies, the private sector, academics and NGOs, to disseminate the advances • Intersectoral meeting for collective reflection regarding the limitations, advantages and needs for management and research on chemical substances in Mexico: April 24th, 2012

  28. The way forward… • Publication of the National Chemicals Inventory: Between July and October 2012 • Proposal for public policy and updating of the legal framework: October 2012 to March 2013
