  2. HAK ASASI MANUSIA Pengertian : HAM yaitu hak dasar yg dimiliki manusia sejak lahir sebagai anugrah Tuhan YME

  3. Macam-macam HAM • HAM menurut bidangnya : • Hak asasi pribadi (personal rights) contoh : kebebasan memeluk agama • Hak Asasi ekonomi (property rights) contoh : hak memiliki sesuatu • Hak asasi mendapatkan perlakuan yg sama dlm hukum dan pemerintahan (rights of legal equality)

  4. Hak asasi politik(political rights) contoh : hak untuk memilih • Hak asasi sosial dan kebudayaan (social and cultural rights) contoh : hak memperoleh pendidikan • Hak untuk mendapat perlakuan tata cara peradilan dan perlindungan (procedural rights)

  5. HAM dilihat dari sifatnya : • Hak asasi manusia klasik,hak yg timbul dari keberadaan manusia itu sendiri, contoh : hak hidup, hak beragama • Hak asasi sosial, hak yg berhubungan dg kebutuhan manusia, contoh : hak memperoleh sesuatu, pendidikan, dll

  6. Macam-macam Piagam HAM : • Magna Charta(1215) di Inggris • Habeas Corpus Act(1679) di Britania Raya • Bill of Rights(1689) di Britania Raya • Delaration of Independence(1776) di Amerika • Declaration des Droits de L’homme et Du Citoyen (1789) di Perancis

  7. Atlantic Charter (1941) plopornya FD. Roosevelt • Universal Declaration of Human Rights (1948), yaitu pernyataan sedunia tentang hak asasi manusia • Pembukaan UUD 1945, merupakan piagam Hak asasi manusia di Indonesia

  8. Langkah-langkah penegakan HAM di Indonesia • Ada 2 macam cara, yaitu : • Langkah secara politis, misalnya dengan keluarnya : • Keppers No. 50/1993 tentang pembentukan Komnas HMA • Keppres No. 181/1998 tentang Komisi Nasional Anti Kekerasan terhadap Perempuan

  9. Secara Yuridis, yaitu dengan melakukan penuntutan dimuka pengadilan. Contoh : • Kasus penembakan di Semanggi • Pembunuhan tokoh HAM yaitu Munir
