Ch 10 Audiovisual Policy • AVMS Directive 2010/13/EU • Will be transposed into Icelandic legislation by the new Media Bill which is currently discussed in the Parliament. • 1. Commercial communications: No alcoholic beverage, tobacco, medicine, lottery and betting + protection of children • 6. Protection of minors: No material which is not considered suitable for minors • 7. Cinema Communication : State aid rules / grants for film production in Iceland

General principles • Reception and retransmission: No provisions in the Broadcasting / Media act to restrict the reception or retransmission of audiovisual media services from EEA states. Exceptions in #5 and #6 in the Media Act. • Issue that requires specific negotiations: • EEA-agreement: Proposed adaptation: Ban on advertisement for alcoholic beverages in cable-TV and over retransmission in Digital terrestrial television (DTT). Ongoing discussion with COM.

Principles of Jurisdiction • # 4 in the Media Act: • Iceland has jurisdiction over media service providers that transmit audiovisual material and are established in Iceland… • Iceland has jurisdiction over media service providers that transmit audiovisual material and are established neither in Iceland …nor in another EEA member state…if they use a terrestrial station located in Iceland …or they use the transmitting capacity of a satellite associated with Iceland…
Ch 10 Audiovisual Policy • 3. Major Events • Provided for in the Media act in # 48 and in the current Broadcasting Act but has not been implemented due to political reasons. Consultation and preparation for a regulation with a list of selected major events has started .

Promotion and distribution of European works • #33 and 34 in the Media Act: • Media service providers transmitting audiovisual • material in a linear schedule shall: • strive to have the greater part of their transmission • time devoted to Icelandic and European works … • as far as possible, ensure that at least 10% of their • transmission time or at least 10% of their annual • programming budget, is devoted to European works • that are produced by independent producers.

Commercial communications • #37 & 38 in the new Media Act: • Audiovisual commercial communications for tobacco products, alcoholic beverages, [prescription] medicinal drugs and lottery and betting operations not authorized by law are prohibited… • Advertisements etc. shall be designed and transmitted in such a way as not to cause moral or physical damage to minors…no ads for unhealthy food!

Protection of minors • # 28 in the new Media Act: • Media service providers may not transmit material, (incl. ads) which might have a damaging effect on the physical, mental or moral development of minors; in particular this refers to material involving pornography or gratuitous violence. • # 36 in the new Media Act: Right of reply • Act. No. 62/2006 on monitoring of children’s access to DVD, Games, Films, self-regulation etc.

Cinema Communication • Icelandic Film Centre and Fund, Act No. 229/2003 • Grants from the Icelandic Film Fund can be made to support the writing of manuscripts, film development, production, post-production and promotion. Only production companies registered in Iceland can apply for financial support. • Reimbursement, Act. No. 43/1999 : Producers can apply for reimbursements from the State Treasury of 20% of the costs incurred in the production of films and television programmes in Iceland.
