  2. Federal Funding • In 1975, Congress promised to pay 40 percent of the cost of special education as part of the IDEA ACT.

  3. Federal Funding • The Office of Special Education Programs (OSEP) is responsible for improving results for infants, toddlers, children and youth with disabilities ages birth through 21 by providing leadership and financial support to assist states and local districts. • OSEP is responsible for ensuring states' compliance with the Individuals with Disabilities Education Act (IDEA).

  4. Formula Grants • The IDEA Part B formula grant programs assist states in providing a free appropriate public education in the least restrictive environment for children with disabilities ages 3 through 21.

  5. Discretionary Grant • OSEP, through Part D of IDEA provides discretionary grants to institutions of higher education and other non-profit organizations to support research, demonstrations, technical assistance and dissemination, technology, personnel development and parent-training and information centers.

  6. Lack of Federal Funding • On average, most states estimate that special education funding monies from the federal government make up less than 15%. This leaves the local school districts to fund the remaining costs of mandated special education services.

  7. State Funding • Office of Special Education Programs - The office implements state and federal laws and regulations governing special education to ensure that pupils with disabilities in New Jersey receive full educational opportunities. • The office is responsible for administering all federal funds received by the state for educating pupils with disabilities ages 3 through 21.

  8. State Maintenance of Financial Support Waivers under Part B • Requests can be made for a one-year waiver of the IDEA maintenance of financial support requirement. • The states have the right to lower their out put of funds to special education programs as long as it is not less than last years amount.
