  6. Intro to Shariah Law Under Shariah law, the clothes you wear, music you listen to, and television you watch would all be censored. Behavior in public is legally restricted and controlled. And Shariah is the ideal social system for those that preach radical (fundamental) Islam. Shariah is an Arabic term referring to a legal framework to regulate public and private aspects of life based upon specific Islamic teachings. Shariah is an intolerant system that threatens the western ideals of “liberty and justice for all.” Shariah views non-Muslims as second-class citizens, sanctions inequality between men and women, prescribes cruel and unusual punishments for crimes, and promotes a restrictive business environment that strangles the freedoms of capitalism.

Intro to Shariah Law • Shariah law is a military political doctrine written 1,200 years ago by Islamic authorities • The goal is to create a one-world militant political Islam through the three forms of jihad: • Violent • Cultural • Financial • Shariah is *not* a religion!(many Muslims oppose Shariah) • It is the law of the land in Iran, Sudan, Saudi Arabia, parts of Nigeria and Indonesia

Intro to Shariah Law It is the ultimate authority of the Taliban, Al Qaeda, Hamas, and Hizbullah There is NO freedom of religion, equal rights, children’s rights, or freedom of speech Criticism of Islam or leaving the faith is a crime punishable by death (a brutal death) It includes forced child marriages, the beating of disobedient wives, public hanging of homosexuals, and persecution of those who do not believe in Islam

From “Reliance of the Traveller” • Shariah on Family Law • Women are eligible for only half of the inheritance of men, may be beaten by their husbands, do not have full stature in the law, are inferior to men in intelligence and religion, and carry a testimony worth half that of a man • Virgins may be married against their will by a father or grandfather • Arab women may not marry non-Arab men • Women may not leave the house without a husband’s permission • Muslim men may marry up to 4 women, including Christians and Jews; Muslim women may marry only Muslims

Honor Killings • Not directly allowed in Shariah! • Although a wife may be beaten to enforce the rule of the male, honor killing is not afforded a legal status • However, there is no penalty for killing an adulterer • RotT: • (o5.4): There is no expiation for killing someone who has left Islam, a highwayman or a convicted married adulterer… • (e12.8): …unworthy (those who may be killed) includes…convicted married adulterers… • The man rules the woman and his status in the community depends largely upon how his women conduct themselves • “Ghira” is a sacred jealousy, represents their self-respect, and is the basis for honor killings

Shariah in Europe • Shariah in Europe Today • Times when traffic cannot move due in the streets of London due to Muslims gathering to pray to their god • Entire areas of Europe have been made into no-go zones for non-Muslims (including the police) • Only Islamic-approved textbooks can be used in classrooms • Christians may not speak to Muslims about Christianity • Rape committed by Muslims is so common in Sweden that the country is now forbidding police from collecting evidence in the investigations that would point to Islam

Shariah in Europe • Shariah in Europe Today • In London there are regular mass demonstrations calling for the abolishment of British law and the establishment of Shariah law to rule ALL people, not just Muslims • In some hospitals during the Ramadan fast, non-Muslims cannot eat where a Muslim can see them (this submissive status is called dhimmi) • In British hospitals women are treated only as Shariah law allows

Shariah in America • Shariah in America Today • The attack on the United States was in compliance with the Qur’an and the doctrine of jihad • The attack was political • Textbooks in America are being approved by Islamic councils • American employers and schools are being forced to provide time and space to perform Islamic prayer • The banking systems is being forced to provide Shariah-compliant financing • Universities are forced to provide sexually-segregated swimming pools and other athletic facilities

Shariah in America • Shariah in America Today • Hospitals are being sued for not providing Shariah-compliant treatment • Courses at the university level no longer employ critical thinking regarding the history and doctrine of Islam(under Shariah, NOTHING about Islam may be criticized) • Muslim charities (deemed “moderate” by our government) give money to jihadist organizations • Foot baths are being installed at airports (paid for by you) • Prisons are proselytizing for Islam • Workplaces are also bending backward to provide special rooms and time off to pray • Churches are bending backward to adopt “friendship” with Muslims and compromise the Word of efei so as not to offend the Muslim, all under the auspice of witnessing (read more about the “jesus in the Qur’an” group at our Website)

Shariah to You and Me • Why Must We Know Shariah? • Islamic scholars claim: • To the Muslim, Shariah law is perfect, universal, and eternal • By contrast, the laws of America are temporary, limited and will pass away • It is the duty of every Muslim (yes, even the “moderates”) to obey their god’s laws (Shariah) • They recognize no man-made laws • Shariah • There are no common principals between American and Shariah law

Shariah to You and Me • Why Must We Know Shariah? • Under Shariah Law • There is no freedom of religion • There is no freedom of speech • There is no freedom of thought • There is no freedom of artistic expression • There is no freedom of the press • There is no equality of peoples – a non-Muslim, a Kafir, is never equal to a Muslim • There is no equal protection under Shariah for different classes of people – justice is dualistic with one set of laws for the Muslim men and different laws for women and non-Muslims • There are no equal rights for women • Women can be beaten • A non-Muslim cannot bear arms • There is no democracy (this would mean equality among Muslims and non-Muslims) • Our Constitution is a man-made document of ignorance (jahiliyah) that must submit to Shariah • Non-Muslims are dhimmis(third-class citizens) • All governments must submit to Shariah law • Shariah law is not interpretive and it cannot be changed • There is no Golden Rule

Three Views of Islam • If you believe Muhammad is the prophet of the god of Islam (tgoi), you are a believer • If you do not believe that, you are a non-believer (a Kafir) • Apologist for Islam: do not believe that Muhammad is the prophet of tgoi, but they tolerate Islam without ever seeking actual knowledge of Islam • So, according to the three views, the killing of the 800 Jews was either: • A perfectly sacred act • A tragedy • Another historical event…other religions have done worse

What is Shariah? • Shariah is the basis for every demand Muslims make on our society • School demands for prayer accommodations • Muslims wearing head scarves • Newspapers not publishing cartoons about Muhammad • Hospitals treating women in special ways • Textbooks vetted by Muslim organizations before they can be used in schools • The attack on the World Trade Center – carried out according to Shariah law • Make no mistake, Islam, and the implementation of Shariah law, if a political move; it is *not* religious!

  30. Shariah Finance • Paying interest is “haram” (opposite of “halal”) • Western example: • Purchase price: $150,000, 15-year note at 5% (zero down) • Monthly payment would be $1,186.19 • Total interest paid would be $63,514.28 • P&I would be $213,514.28

Shariah Finance • Shariah example: • Purchase price: $150,000 • Mortgage company , after finding the interest rate and determining the total interest to be $63,514.28, buys the home for $150,000 and then sells it to the borrower for $213,514.28 ($150,000 plus $63,514.28) • Monthly payment would be $1,186.19 for 15 years (180 payments) with “zero” interest • Total interest paid would be $0 (anyone laughing yet?) • Principal repaid would be $213,514.28

  32. “Shariah” translation: path, or path to water “Šariat Allah” (god’s Law), refers to the legal framework within which the public and private aspects of life are regulated for those living in a legal system based on Islamic principles of jurisprudence

  34. Legislative Powers US Constitution Article I - All legislative Powers shall be vested in the Congress. Shariah Law The source of legal rulings for all acts of those who are morally responsible is Allah. (a1.1) It is not a sin to comply with man-made laws that require buying auto insurance or having a photo ID because “the authorities are responsible for the sin, not the individual forced to comply.” (w42.3 and w50.4)

  35. Power to Declare War US Constitution Section 8 – Powers of Congress include to levy taxes, to make laws, and to declare war. Shariah Law It is obligatory to obey the commands and interdictions of the caliph or his representative in everything that is lawful, even if he is unjust .. . because the purpose of his authority is Islamic unity, which could not be realized if obeying him were not obligatory. (o25.5) The caliph or his representative have the duty of undertaking jihad if their territory borders on enemy lands, of dividing the spoils of battle, and of remitting a fifth for “deserving recipients.” (o25.9(8)) Jihad is obligatory for everyone when the enemy has surrounded the Muslims. (o9.3) It is permissible in jihad to cut down the enemy’s trees and destroy their dwellings. (o9.1)

  36. President (Caliph) US Constitution Article II, Section I -- Qualifications of a President – He must be a natural born citizen, thirty-five years old, and a resident for fourteen years. The President is elected by ballot by the people (via the Electors) and shall serve for no more than 2 four-year terms. No religious test shall ever be required as a qualification to any office or public trust under the United States. Shariah Law A caliph must be a Muslim, a non-slave, a male, of the Qurayshtribe. (o25.0) The Caliph appoints a group to select his successor among themselves. There is not a term of office. However, the caliphate of someone who seizes power is considered valid, even though his act of usurpation is disobedience, in view of the danger from anarchy and strife that would otherwise ensue. (o25.4(3))

  37. Removal of Government Officers US Constitution Section 4 – The President and all civil Officers of the United States shall be removed from office if found guilty of treason, bribery, or other high crimes and misdemeanors. Shariah Law (No provision for removal from office)

  38. Legal Authority US Constitution Article 6 – This Constitution and the laws of the United States which shall be made under it shall be the supreme law of the land, and judges in every state shall be bound by them. Senators and Representatives, legislative officers, all executive and judicial officers both of the United States and the several states shall be bound by a Oath or Affirmation to support the Constitution. Shariah Law The source of legal rulings for all acts of those who are morally responsible is Allah. (a1.1)

  39. Civil and Religious Rights US Constitution Amendment 1 – Congress shall make no law respecting an establishment of religion, prohibiting the free exercise thereof, or abridging the freedom of speech, or the press, or the right of the people to peaceably assemble, and to petition the Government for redress of grievances. Shariah Law Non-Muslims are obliged to comply with Islamic rules that pertain to the safety and indemnity of life, reputation, and property. Non-Muslims are forbidden to openly display wine or pork, recite their scriptures, or make a public display of feast days or funerals. Non-Muslims are forbidden to build new churches. A non-Muslim may not enter a mosque without permission. The protection for non-Muslims is withdrawn if a non-Muslim commits adultery with a Muslim woman or marries her, leads a Muslim away from Islam, kills a Muslim, or says anything derogatory about Allah, the Prophet, or Islam. (o11.5 through o11.10)

  40. Civil and Religious Rights US Constitution Amendment 2 – The right of people to keep and bear arms shall not be infringed. Shariah Law It is a condition that someone buying weapons be of a people who are not at war with Muslims. (k1.2(f)) Enormities (sins) include selling weapons to non-Muslims who will use them against us. (w52.1(192))

  41. Civil and Religious Rights US Constitution Amendment 3 – No soldier shall, in time of peace be quartered in any house, without the consent of the owner, nor in time of war, but in a manner prescribed by law. Shariah Law (Not covered.) However, the Pact of Omar (636 AD) imposed on Christians in Syria, “We shall keep our gates wide open for passersby and travelers. We shall give board and lodging to all Muslims who pass our way for three days.”

Civil and Religious Rights US Constitution Amendments 4 – 8 – These amendments prohibit unreasonable searches, require due process according to the law, provide for confrontation of witnesses, impose jury trial on all matters involving over $20, and prohibit excessive fines and cruel and unusual punishments. Amendment 14 provides for equal protection of the laws for all citizens. Shariah Law No testimony may be made by people who have lowly jobs, such as a street sweeper or a bath house attendant, or non-Muslim. (o24.2-3) Testimony regarding fornication or sodomy requires four male eye-witnesses to the act. (o24.9) A woman’s testimony is worth only half that of a man. (o24.10) (There is no provision for a jury trial under Shariah Law.) Cruel and unusual Islamic punishments include 1) stoning for adultery (o12.2); 2) scourging 40 lashes with hands, shoes, ends of clothes, or a whip for drunkenness (o16.3); 3) severing the right hand for theft of over $36 and the left foot for a repeat offense (o14.1); and 4) death for apostasy from Islam. (o8.2) Indemnity for accidentally killing a male Muslim is 100 camels or 4,235 grams of gold. (Current value: $144,000.) Indemnity for killing a woman is half that of a man, for killing a Jew or a Christian is one-third of the indemnity paid for a Muslim. The indemnity paid for a killing Zoroastrian is one-fifteenth of that of a Muslim. The indemnity for causing a miscarriage is one slave. (o4.9) There is no indemnity for a killing a non-Muslim at war with Muslims, an apostate, or someone sentenced to death by stoning. (o14.17) Jews and Christians are subject to a “poll tax” not less than 1 dinar (Current value: $144) per adult male per year. No maximum is stipulated. (o11.4) This is a penalty for remaining in their ancestral religion instead of embracing the “religion of truth.” (o9.8) A husband may beat a “rebellious” wife for 1) not allowing immediate sexual intercourse when he asks for it, at home, and if she can physically endure it; 2) answering him coldly; or 3) being averse when she was previously kind. (m5.1 and m10.12) The only limitation is that he may not break her bones, wound her, or cause bleeding.

  43. Civil and Religious Rights US Constitution Amendment 13 Slavery and involuntary servitude are abolished. Shariah Law The section on Slavery (k32.0) is not translated into English. The provisions remain in Arabic. The editor of “The Reliance of the Traveler” claims that these provisions are no longer applicable, yet they remain in there in the text of Shariah Law. Elsewhere, the manual states, “Originally the status of slave was simply the outcome of having been taken as a prisoner of war. A captive who could not buy his own freedom by means of ransom remained in the possession of the captor until he had earned his freedom by work or until he was granted liberty by his master.” (w13.1)

  44. Civil and Religious Rights US Constitution Amendment 21 repealed “prohibition,” thereby allowing manufacture, sale, and transport of alcoholic beverages. Shariah Law It is unlawful to sell grapes to someone who will make wine from them. (k4.9) “Allah cursed whoever drinks wine, gives it to others to drink, sells it, buys it, presses it for another, transports it, receives it, or eats its price.” Enormities (sins) include drinking wine in any form or other intoxicant, even if only a drop as in medicine; pressing out the juice to make wine or other intoxicant; carrying it for purposes of drinking, or having it carried; serving it to others or having it served; selling it; buying it; having it bought or sold; consuming proceeds from selling it; or keeping wine or other intoxicant. (o16.6 and w52.1(350-361))

  45. "Supreme Court cases have been heard on far less-obvious violations of our Establishment Clause. Many, if not most, American Muslims are currently well able to accommodate our own prayers and ablution to the spaces and facilities provided to all other faiths on public grounds without special accommodations. Islamists use the 'free exercise' clause when it suits them and then turn around and use tax monies in the name of Islam when it suits them. The foot bath marks the start down a slippery slope of preferential treatment of one religion over another, which is what the First Amendment was established to prevent. These baths exert a monetary cost upon publicly funded institutions which by our Constitution should not appease the financial demands of one faith group over another, every other faith group on campus should be demanding that they be provided equal funding and space – which basically demonstrates how outrageous these accommodations are."

Judge Joseph Charles “This court does not feel that, under the circumstances, that this defendant had a criminal desire to or intent to sexually assault or to sexually contact the plaintiff when he did. The court believes that he was operating under his belief that it is, as the husband, his desire to have sex when and whether he wanted to, was something that was consistent with his practices and it was something that was not prohibited.”
