  6. II. Steps to progress on the CAM NC implementation NRAs regulatory development • Spain: • A CNMC Circular to be approved by the BoR. Last revision has taken into account the comments received (10) in Public Consultation, in particular focused on clarification of some provisions. • France: • The tariff related aspects have been reflected in the yearly deliberation on transmission tariffs (11 December 2013). • A Public Consultation has been launched by CRE, on the basis of GRTgaz’ and TIGF’s proposals. It is open until 31 January 2014. CRE’s deliberation is due by mid-February. • Portugal: • A ERSE Deliberation based on the conclusions of the SGRI.

Steps to progress on the CAM NC implementation Issues to be agreed • Capacity figures to be offered in March and June: TSO must provide ASAP the available capacity according to the following principles: • ES-PT: • 90% of available technical capacity for yearly auction • 10% of available technical capacity for quarterly auction. • ES-FR: • 80% of available technical capacity for yearly auction for 15 years • 10% of available technical capacity for yearly auction for 5 years • 10% of available technical capacity for quarterly auction. • Default rule (unless otherwise stated) is that interruptible capacity is offered only if 98% of the corresponding technical capacity has previously been sold

Steps to progress on the CAM NC implementation Issues to be agreed • Transferring of existing contracts from physical IPs to the VIP. • Before 1 October existing contracts must be adapted • TSOs will establish deadlines in relation to: • Communication to shippers • TSOs and shippers agreements • Information to the NRAs in the Region • Definition of large and small price steps for each type of product. • For the annual auction in March 2014, TSOs inform the NRAs of the price increments envisaged, at the latest one month in advance.

Steps to progress on the CAM NC implementation Issues to be agreed • Documents to upload by TSOs in PRISMA: General Terms and Conditions for shippers. • Deadline to be published: 1 February 2014 • Deadline for shippers to accept them • Clarification on the potential offer of unbundled capacity and interruptible capacity in 2014? • Is there any interruptible capacity to be offered for March and June auctions? • Is there any unbundled capacity to be offered? • When will it be offered to the market? • Secondary market: when and where trades will take place, public information. • PRISMA secondary market functions will be available in April 2014.

Steps to progress on the CAM NC implementation Issues to be agreed • Exchange of information between adjacent TSOs • Coordination between TSOs is required. • Information to be exchanged and published in: • TSOs websites: link to PRISMA, data included in TSOs regular publications • NRAs to be informed after the auction • NRAs and the market if needed following the REMIT provisions. • NRAS and the market to be informed as soon as possible in case of disruption • Identify improvements for next auctions: TSOs, potentially in coordination with PRISMA, to submit an annual report of the results and ways to improve the process to NRAs. • Stakeholders information: • TSO will communicate results of the auctions: aggregated to the market, allocated capacity to the participant –need to define the procedure specifically for day and intraday auction results (immediately after auctions)

Steps to progress on the CAM NC implementation Issues to be agreed • Monitoring by NRAs • NRAs will have access to auctions information via PRISMA. • NRAs could request TSOs information to perform the monitoring task. • Information about other capacity allocations calendar in the region and beyond • OSP 2014 ES-FR: Short term capacity to be allocated at Larrau IP from 1 April 2014 to 30 September 2014 ONGOING • Calendar of national allocations that could be interesting for the market.
