SL 2011-60: Unborn Victims of Violence Act/ Ethen’s Law An act to create criminal offenses for acts that cause the death or injury of an unborn child or are committed against a pregnant woman. 03/02/11: Bill filed 04/29/11: Bill signed into law 12/01/11: Effective date of law and for offenses.

  5. SL 2011-145: Appropriations Act of 2011, Sec. 29.23 (a)–(c) Budget bill includes permanent language to limit state abortion funding in the health plan. No state funded abortionsexcept in cases of rape, incest, or to save the life of the mother. 03/01/11: Bill filed 04/26/11: Language included 06/04/11: Chambers send to Governor 06/12/11: Governor Perdue vetoes budget 06/15/11: Override Governor Perdue’s veto; becomes law 01/01/12: Effective date for the new state health plan limits

  6. SL 2011-392: Authorize Various Special Plates An act to authorize the Division of Motor Vehicles to issue various special registration plates. The money raised is to go to the Carolina Pregnancy Care Fellowship (SL 2013-260, Sec. 12J.1.(a)). “Choose Life” plate is added to this list. 05/18/2011: Bill includes “choose life” plate. 06/30/2011: Signed into law by Governor. November 2011: US District Ct. Judge temporarily blocked the law. December 2012: US District Ct. ruled plates unconstitutional. February 2014: US Court of Appeals 4th Circuit rules plates unconstitutional. October 2014: Now on appeal to U.S. Supreme Court

SL 2013-360: Appropriations Act of 2013SL 2014-100: Appropriations Act of 2014 • Budget bill that included a provision for maternal and child health block grants and provided $250,000 to the Carolina Pregnancy Care Fellowship (SL 2013-260, Sec. 12J.1.(a)). • These funds were originally intended to replace the funds that would have been raised by “Choose Life” license plates. • 05/21/13: Funds listed in Budget bill • 07/24/13: Chambers pass bill and send to Gov. McCrory • 07/26/13: Governor McCrory signed into law; funds disbursed. • 08/07/14: Appropriations for ‘14-’15 raised to $300,000 (SL 2014-100, Sec. 12J.1.(a)).

  8. SL 2011-405: Woman’s Right to Know Act WRTK Act: To require a 24 hours waiting period and the informed consent of a pregnant woman before an abortion may be performed.

WRTKTimeline • Filed bill on 04/06/11 • Passed House/Senate & sent to Governor on 06/17/2011 • Governor Perdue vetoed on 06/27/2011 • Overrode veto and became law 07/28/2011 • Act effective 90 days after becomes law (Late October) • Applied to claims for relief on or after October 1, 2011 • Only the provision for displaying ultrasounds was enjoined in Stuart v. Huff, 706 F.3d 345, 2013 (4th Cir. NC 2013)-. • US District Ct. Judge ruled against ultrasound images in January 2014. • The provision is currently on appeal to 4th Circuit Court of Appeals. • The rest of the law has been in effect since October 2011.

SL 2013-SL 2013-307: Health Curriculum/Preterm Birth Include instruction in the school health education program on the preventable causes of preterm birth, including induced abortion as a cause of preterm birth in subsequent pregnancies. 02/25/13: Bill filed 07/09/13: Bill sent to Governor McCrory 07/18/13: Signed into law by Governor McCrory To apply beginning in the 2013-2014 school year. 2014-2015 curriculum currently being reviewed.

SL 2013-366: Health and Safety Law Changes • Act to modify certain laws pertaining to abortion: • To limit abortion coverage (to rape, incest, or to protect the death of the mother) under health insurance plans offered under the federal health benefit exchange operating in NC or offered by a county or municipality; • To prohibit performing an abortion when the sex of the unborn child is a significant factor in seeking the abortion; • To direct the Department of Health and Human Services to amend rules pertaining to abortion clinics; • To amend the WRTK Act by prohibiting webcam abortions, requiring a doctor to be present. • Conscience Protection was extended to all health care providers, not just doctors and nurses.

Timeline of Health and Safety Changes 03/19/13: Bills filed by House and Senate with almost all substantive provisions. 05/07/13: House passed most of this language in HB 716 07/10/13: Language fully added to bill 07/26/13: Chambers passed bill and sent to Governor 07/29/13: Signed into law by Governor McCrory 10/01/13: All parts of law are effective

  14. 10/1/13: All health and safety law changes regarding abortion in effect. 6/30/11: “Choose Life” plate begins fight.. 7/18/13: Preterm birth health curriculum goes into law. 4/6/11: WRTK Act filed. 7/26/13: $250K to Carolina Pregnancy Care Fellowship. 1/1/12: Effective date for new health plan limits on abortion.

  16. NC Resident Abortions 2010-2013 • 2010: 25,808 • 2011: 22, 370 • 13.3% fewer abortions than in 2010. • 2012: 20,973 • 6.2% fewer abortions than 2011. • 2013: 19,818 • 5.5% fewer abortion than 2012. • 2010-2013: • 5,990 fewer abortions (23.2% fewer abortions)

Abortion Statistics: 2011 vs. 2010 • 4,760 fewer reported abortions in 2011. • Down 15.4% from 2010to 2011. • Woman’s Right to Know Act – Effective October 2011 • Unborn Victim’s Act – Effective December 1, 2011 • Both bills filed – Spring 2011 • Appropriations to limit state funded abortions – June 2011 • Not effective until January 2012.

  21. Abortion Statistics: 2012 vs. 2011 • 1,753 fewer abortion procedures in 2012 than 2011. • Down 6.7% from 2011. • Down 21% from 2010. • January 2012: New effective date for abortion limits in the state health plan. • First full year of the Woman’s Right to Know Act.

Abortion Statistics: 2013 vs. 2012 • 1,619 fewer abortion procedures in 2013 than 2012. • Down 6.6% from 2012. • Down 12.9% from 2011. • Down 26.3% from 2010. • Fund Carolina Pregnancy Care Fellowship – Effective July 2013 (but the first money not disbursed until Spring 2014). • Health Curriculum/Preterm Birth – Effective School Year 2013-2014. • Health and Safety Law Changes – All parts effective October 1, 2013.

Key Points from Latest Statistics • African American Women have seen 2,568 fewer abortions from 2010 to 2013. • 22% decrease. • Women age 19 and under have seen 1,523 fewer abortions from 2010 to 2013. • 41.6% decrease. • 696 fewer abortions from 2010 to 2013 for women receiving abortions 13 weeks of gestation onward. • 31.3% decrease. • 2,573 fewer abortions from 2010 to 2013 for women receiving abortions who have previously had an abortion. • 27.7% decrease.
