  3. RSA 193-F Purpose & Intent • All students have the right to attend schools that are safe, secure & peaceful environments • Protect children from physical, emotional & psychological violence • Address bullying AND cyberbullying in schools

  4. Includes actions motivated by… • Race • Color • Religion • National origin • Sexual orientation • Social economic status • Age

  5. Includes actions motivated by… • Physical, mental, or learning disability • Gender • Gender identity & expression • Obesity • Other physical characteristics • Association with any person identified in any of these categories

  6. Definitions - Bullying can be: • A single significant incident or a pattern of incidents involving written, verbal or electronic communication • A pattern of incidents involving physical acts or gestures • Or any combination

  7. If these acts… • Physically harm a pupil or damage a pupil’s property • Cause emotional distress to a pupil • Interfere with a pupil’s educational opportunities • Create a hostile educational environment • Substantially disrupt the orderly operation of the school

  8. Bullying shall include • Actions motivated by an imbalance of power, based on perceived or actual characteristics, behaviors or beliefs OR • Motivated by the pupil’s relationship with another person

  9. Cyberbullying • Conduct previously defined undertaken through the use of electronic devices

  11. Cyberbullying It is important to remember to remind parents to: • Print text messages received • Save and print any internet forms of communication received

  12. RSA 193-F requires a policy that includes Fourteen (14) specific steps including a statement: • Prohibiting bullying • Protecting against retaliation • That ALL students are protected • Of consequences • Of a clear reporting procedure

  14. RSA 193-F requires a policy that includes Fourteen (14) specific steps including a statement: • Each local BOE must adopt a Bullying Policy by January 1, 2011. • All public school staff and volunteers must be trained by April 1, 2011.

  20. Nashua BOE Policy JICK Prohibits False Reporting • Consequences range from positive behavioral interventions up to and including suspension or expulsion

  22. Nashua BOE Policy JICK Reporting Procedure • Principal or designee is responsible for receiving & responding to reports • All reports go to principal or ANY school employee • All school employees MUST inform the principal or designee ASAP but no later than the end of the day

  23. Nashua BOE Policy JICK Reporting Procedure • Pupils, parents, volunteers and visitors may report anonymously • Principal or designee shall commence an investigation upon receipt of a report

  24. Nashua BOE Policy JICK Notifying Parents • Victim’s AND perpetrator’s parents MUST be notified of a report within 48 hours • By telephone, writing, e-mail or conference • Superintendent may grant waiver

  25. Nashua BOE Policy JICK Investigation Procedures & Timeline • Five (5) school days to initiate investigation • Ten (10) school days to complete the investigation • Interview victim, alleged perpetrator & witnesses • Superintendent may grant seven (7) day extension of investigation

Nashua BOE Policy JICK Investigation Procedures & Timeline • If at the end of the year use calendar days for timeline • Substantiated incidents documented in pupil records of perpetrator & victim • If behavior is criminal, the principal shall notify local law enforcement • Parents notified of results of investigation within two (2) days of conclusion

  27. Nashua BOE Policy JICK Response/Remediation Plan • Substantiated bullying may result in punishment • Consequences will be varied according to the nature of the behavior, the developmental age of the pupil & the pupil’s history

Nashua BOE Policy JICK Response/Remediation Plan • Consequences could include early intervention measures, alternative dispute resolution, conflict resolution, written apology, community service, transfer to another school, counseling as well as discipline up to and including suspension and/or expulsion.

Nashua BOE Policy JICK Right of Appeal (Non-disciplinary remedial actions) • Within five (5) days to Superintendent • Superintendent must respond within ten (10) days • Within ten (10) more days to the Board of Education • Board informs parents of right to appeal to New Hampshire State Board of Education

  31. What is bullying? It: • Is learned behavior • IS NOT prewired, harmless, inevitable • Will spread if ignored, supported, or promoted • Can be controlled or prevented

Who are the models? • Family – Parents, siblings and other adult care givers • School – Teachers, Principals, Peers • Community – Adults at church or temple, scouts, coaches, police officers, etc. • Media models – sports figures, “news”, politics, TV, magazines, movies, music, toys, video games, etc.
