  2. INTRODUCTION CurbingPoliceMisconductintheUnitedStatesofAmerica isaHerculeantask. MostAmericanstrulybelievethat policeofficersdon’tdobadthingstopeoplewhodon’t deserveit. Theytrulybelievethatmostpoliceofficersare honestpeopledoingatoughanddangerousjob; onlytobe unfairlycriticizedbythe “liberalmedia”, andtaintedbyfew “badapples”. MostAmericansalsotrulybelievethatsincetheydon’t commitanycrimesotherthanspeedingoranoccasional DUI, thatthepolicearenotgoingtobotherthem; and, if theydo, thatthepolicewilltreatthemrespectfullyand professionally. Unfortunately, thisbeliefsystemisthebiggestimpediment tocurbingpolicemisconductinAmerica. Inthatworld view, thereisnoreal “PoliceMisconduct” problematall. Thatwillgetyoupulledoveroften. Thatisnotlefty propaganda. Thatisreality. It’samazinghowmanylicense platetagsgetcovered-upbymudonMercedes-Benzautos drivenbyblackpeopleinniceneighborhoods; eveninliberal California. Maybetheofficerjustpats-downallmotoristswhohestops, notwithstandinganyconstitutionalprohibitionofsuch warrantlessandsuspicion-lesssearches. Thisreallydoes happen. Afterall, it’ssaferbutunlawfulforanofficertofrisk anyonethathestops, andwithmanycops, ifyouappearin anywaytobeofsemi-questionablecharacter, theyaregoing towanttofriskyou.

ThePoliceProtectThemselvesfromTheirVictims ByFalselyArrestingandFalselyAccusingThem ofResistanceOffenses Iftheofficerinjuredthegood-citizentypebadlyenough, thepolicewill increasetheseverityofthe “resistanceoffense”, fromsay misdemeanorresisting / delaying / obstructingofficer (i.e. Cal. Penal Code § 148(a)(1), “TheBootofthePoliceState“) iftheofficerdoesn’t injureyoubadly, tofelony “resistingofficerwiththreatoforuseof violence” (Cal. PenalCode § 69, “TheHammerofOppression“) ifthey beatyouupsomewhatbadly. Iftheofficerinjuredthegood-citizentypebadlyenough, thepolicewill increasetheseverityofthe “resistanceoffense”, fromsay misdemeanorresisting / delaying / obstructingofficer (i.e. Cal. WhyWeBelieveThatThePoliceDon’tDoBadThings toPeopleWhoDon’tDeserveIt Wearetaughtsincechildhoodtobelievethatthepolicearehereto “ServeandProtect” usfromcriminals, andsometimes, fromourselves (i.e. drugpossession). ThesewordsareingrainedinourAmerican psyche. Whenprospectivejurorsareasked “Whydoyouthinksomeone becomesapoliceofficer“, ninety-fiveorsooutofone-hundredwillsay: “ToProtectandServe“. Moreover, everyonehasbiases, andnoneofuscanviewtheworldother thanthroughlensescoloredbythosebiases. BecausemostAmericans haveneverbeenthesubjectofpoliceoutrages, orhaveneverpersonally seensuchevents, mostlaw-abidingAmericansseetheworldthrough blue-colored-lenses; confirmationbiastowardthepolice. Whenwehearaboutanaltercationbetweenapoliceofficeranda civilian, weassumethattheofficeris “intheright“, andthatthecivilianis “inthewrong“. ItisanaturalreactionofmostAmericans, duetotheir confirmationbiastowardthepolice.

WhyWeBelieveThatTheCourtsProtectthe CriminalsfromthePolice MostAmericans, thosewithoutarealunderstandingofthe AmericanCriminalJusticeSystem, seeourcriminaljusticesystem asabunchofhired-gunlawyersandliberaljudges, more concernedwiththerightsoftheaccusedthanthoseofthevictims. Ofcoursetheproblemwiththatmentality, isthatthepersonwho isontrialandisbeingprosecutedistheonlyonewhoserightsand freedomareinjeopardy. Moreover, duetopopularcopmovieslikeDirtyHarry, thepublic hasatrulymistakenimpressionaboutourlawsandourlegal system. Forexample, mostAmericansareunderthemistaken impressionthatthepolicearesomehowlegallyobligatedto “read youyourrights“, your “MirandaWarnings” iftheyarrestyou; somethingcompletelyuntrue. AllthatMirandav.
