  1. NCAA Transfer Rules & Evaluating Transfer Transcripts = FUN!!!... SJSU Athletics Compliance Education Sessions December 14 & 16, 2010

  2. 1. Which of the following triggers transfer status? • D. Any of the above • Bylaw 14.5.2 sets forth the following conditions that make an individual a transfer student: (a) The student was officially registered and enrolled in a minimum, full-time program of studies in any quarter/semester of an academic year, as certified by the registrar or admissions office, provided the student was present at the institution on the opening day of classes; (b) The student attended a class or classes in any quarter/ semester in which the student was enrolled in a minimum full-time program of studies, even if the enrollment was on a provisional basis and the student was later determined by the institution not to be admissible;

  3. Bylaw 14.5.2 Continued… (c) The student is or was enrolled in an institution in a minimum full-time program of studies in a night school that is considered to have regular terms (semesters/quarters) the same as the institution's day school, and the student is or was considered by the institution to be a regularly matriculated student; (d) The student attended a branch school that does not conduct an intercollegiate athletics program, but the student had been enrolled in another collegiate institution prior to attendance at the branch school (e) The student attended a branch school that conducted an intercollegiate athletics program and transfers to an institution other than the parent institution;

  4. Bylaw 14.5.2 Continued… (f) The student reported for a regular squad practice (including practice or conditioning activities that occur prior to certification per Bylaws 14.3.5.1 and 14.5.4.5.5), announced by the institution through any member of its athletics department staff, prior to the beginning of any quarter/semester, as certified by the athletics director. Participation only in picture-day activities would not constitute "regular practice;" (g) The student participated in practice or competed in a given sport even though the student was enrolled in less than a minimum full-time program of studies; or

  5. Bylaw 14.5.2 Continued… • (h) The student received institutional financial aid while attending a summer term, summer school or summer-orientation program (see Bylaws 15.2.8.1.3 and 15.2.8.1.4).  A recruited student who receives institutional aid pursuant to Bylaw 15.2.8.1.4 is subject to the transfer provisions, except that a prospect (recruited or nonrecruited) who is denied admission to the institution for full-time enrollment shall be permitted to enroll at another institution without being considered a transfer student.

  6. 2. A student who attended only summer school classes at an institution is considered a transfer. • False • Per Bylaw 14.5.3.1, enrollment in or attending classes only in summer school will not trigger a student’s transfer status. • BUT, if the student receives institutional financial aid for summer school then he/she will be considered a transfer per Bylaw 14.5.2.

  7. 3. The general rule is that a student who transfers to a Division I institution must serve a year in residence upon transfer, regardless of the sport. • True • Per Bylaw 14.5.1, a student who transfers from any collegiate institution is required to complete one full academic year of residence at the certifying institution (SJSU) before being eligible to compete for or to receive travel expenses from the member institution, unless the student satisfies the applicable transfer requirements or qualifies for one of the many transfer exceptions.

  8. 4. A transfer may use a summer term to complete his/her year in residence. • False • Per Bylaw 14.02.13, a summer term shall not be used to satisfy a term of residence.

  9. 5. Which of the following are conditions for use of the one-time transfer exception? • D. Both A & B • Per Bylaw 14.5.5.2.10, to use the one-time transfer exception all of the following conditions must be met: (a) The student is a participant in a sport other than baseball, basketball, bowl subdivision football or men's ice hockey at the institution to which the student is transferring. (b) The student has not transferred previously from one four-year institution unless, in the previous transfer, the student-athlete was subject to the discontinued/nonsponsored sport exception;

  10. Bylaw 14.5.5.2.10 Continued… (c) The student is in good academic standing and meets the progress-toward-degree requirements. The transferring student must be one who would have been academically eligible had he/she remained at the institution from which the student transferred, and he/she also must be eligible at the certifying institution as a regularly enrolled, full-time, degree-seeking student who was admitted in accordance with the regular, published entrance requirements of the institution. The student shall not be required to fulfill the necessary percentage-of-degree requirements at the previous institution; and

  11. Bylaw 14.5.5.2.10 Continued… • (d) If the student is transferring from an NCAA or NAIA member institution, the student's previous institution shall certify in writing that it has no objection to the student's being granted an exception to the transfer-residence requirement.

  12. 6. A student who transfers from a four-year institution that dropped his/her sport may be immediately eligible to compete upon transfer. • True, discontinued/nonsponsored sport exception • Per Bylaw 14.5.5.2.6, a student may be immediately eligible upon transfer if any of the following has occurred: (a) The student's original four-year collegiate institution dropped (or has publicly announced it will drop) the sport (in which the student has practiced or competed at that institution in intercollegiate competition) from its intercollegiate program; or

  13. Bylaw 14.5.5.2.6 Continued… (b) The student's original four-year collegiate institution reclassified (or has publicly announced it will reclassify) the sport (in which the student has practiced or competed at that institution in intercollegiate competition) from Division I to Division III status, or  (c) The student's original four-year collegiate institution never sponsored the sport on the intercollegiate level while the student was in attendance at the institution, provided the student had never transferred from any other collegiate institution that offered intercollegiate competition in that particular sport.

  14. 7. A student who transfers from a four-year institution is eligible for institutional athletically related financial aid upon transfer only if he/she would have been academically eligible to compete if he/she had remained at the previous institution. • True • Per Bylaw 14.5.5.4, a transfer student from a four-year institution may receive institutional athletically related financial aid during his/her first academic year at the certifying institution only if he/she would have been academically eligible to compete during the next regular academic term had the student-athlete remained at the previous institution.

  15. 8. A student who transfers from a four-year institution may also be immediately eligible for practice and competition if they fit into which of the following categories? • C. Either A or B • Bylaw 14.5.5.2.8 sets forth the return to original institution without participation or minimal participation exception, whereby a student would be immediately eligible upon transfer back to his/her original institution provided he/she does not compete at the second institution and does not engage in other CARA in the involved sport at the second institution beyond a 14-consecutive-day period.

  16. Bylaw 14.5.5.2.7 sets forth the two-year nonparticipation or minimal participation exception, whereby the student would be immediately eligible if he/she transfers to the certifying institution from another four-year college and, for a consecutive two-year period immediately prior to the date on which the student begins participation, the student has not competed in intercollegiate competition and has not engaged in other CARA in intercollegiate athletics in the involved sport beyond a 14-consecutive-day period, or has neither practiced nor competed in organized noncollegiate amateur competition while enrolled as a full-time student in a collegiate institution.

  17. 9. A 4-2-4 transfer is immediately eligible to practice and compete regardless of whether or not he/she earns an AA degree from the two-year college. • False • Per Bylaw 14.5.6, a 4-2-4 transfer must serve a year in residence at the second four-year institution before competing unless the student has: (a) Completed an average of at least 12-semester or -quarter hours of transferable degree credit, with a cumulative minimum grade-point average of 2.000, acceptable toward any baccalaureate degree program at the certifying institution for each term of full-time attendance at the two-year college following transfer from the four-year college most recently attended; (b) One calendar year has elapsed since the student's departure from the previous four-year college; AND (c) The student has graduated from the two-year college (earned an AA degree).

  18. 10. To be eligible for athletics aid during the first year of enrollment at SJSU, a 4-2-4 transfer must have attended the two-year institution for how long? • A. At least one academic term • Per Bylaw 14.5.6.6, a 4-2-4 transfer must complete at least one regular academic term (fall/spring, not summer) of enrollment at the two-year institution to be eligible for athletics aid at the certifying institution (SJSU).

  19. 11. A two-year transfer who was a qualifier out of high school is eligible for competition in the first academic year in residence if which of the following conditions is met? • D. All of the above • Per Bylaw 14.5.4.1, a two-year transfer who was a qualifier is eligible for competition in his/her first academic year only if the student: (a) Has spent at least one full-time semester or one full-time quarter in residence at the two-year college (excluding summer sessions); (b) Has presented a minimum GPA of 2.000; AND (c) Has satisfactorily completed an average of at least 12-semester or quarter hours of transferable-degree credit acceptable toward any baccalaureate degree program at the certifying institution for each full-time academic term of attendance at the two-year college.

  20. 12. If a transfer student has attended multiple two-year institutions, he/she must complete at least 40% of the credit hours used to fulfill the academic degree requirements at the two-year institution that awards the AA degree. • False • Per Bylaw 14.5.4.5.1, when a student-athlete has been in residence at two or more two-year colleges, the terms of residence at all two-year colleges may be combined in determining eligibility. At least 25% of the credit hours used to fulfill the student's academic degree requirements must be earned at the two-year college that awards the degree.

  21. 13. Which of the following is NOT required for a two-year transfer who was a nonqualifier out of high school to be eligible for institutional financial aid, practice and competition during his/her first academic year in residence? • C. Attended the two-year college as a full-time student for at least four semesters or six quarters • Per Bylaw 14.5.4.2, a two-year transfer who was a nonqualifier is eligible for institutional financial aid, practice and competition the first academic year in residence only if: (a) Has graduated from the two-year college; (b) Has completed satisfactorily a minimum of 48-semester hours of transferable-degree credit acceptable toward any baccalaureate degree program at the certifying institution, including six semester hours of English and three semester hours of Math (first FT enrollment on/after 8/1/09; (c) Has attended a two-year college as a full-time student for at least three semesters or four quarters (excluding summer terms); and (d) Has achieved a cumulative grade-point average of 2.000.

  22. 14. A two-year transfer (initially enrolling at any institution full-time on/after 8/1/09) from a two-year institution who was a nonqualifier out of high school must transfer how many hours of degree credit in English and Math to SJSU to be eligible for aid, practice and competition upon enrollment? • A. 6 hours of transferrable English credit and 3 hours of transferrable Math credit per Bylaw 14.5.4.2 (previous slide!)

  23. 15. A two-year transfer may earn as many transferable degree credit hours as they want during summer terms at the two-year institution. • False • Per Bylaw 14.5.4.2.1, a two-year transfer may not earn more than 18 semester hours of transferable degree credit during summer terms.

  24. 16. What is the maximum number of hours a two-year transfer may earn during the summer term immediately prior to transferring to SJSU? • C. 9 • Per Bylaw 14.5.4.2.1, a student may not earn more than nine semester hours of transferable degree credit during the summer term immediately prior to his/her transfer.

  25. 17. A two-year transfer, who was recruited by SJSU, may practice, but not compete or receive institutional athletics financial aid for a period of how many days prior to SJSU receiving and certifying the student’s official academic record? • B. 14 • Per Bylaw 14.5.4.5.6.1, if a recruited two-year college transfer student reports for athletics participation before the student's high school or two-year college academic record has been certified, the student may practice, but not compete, during a 14-day period, provided the student meets all other requirements to be eligible to practice. An institution shall not provide athletically related financial aid to the student during this period.

  26. 18. A two-year transfer who was a nonqualifier may transfer to SJSU to complete coursework for his/her AA and still be immediately eligible to compete. • False • Per Bylaw 14.5.4.5.5, the two-year college transfer requirements must be met prior to a student-athlete's transfer to the certifying institution. If a two-year college student transfers to a member institution prior to the completion of applicable transfer requirements, the student is subject to the one-year residence requirement at the certifying institution.
