Pasal 4 a. Semua kegiatan penggunaan wilayah udara, navigasi penerbangan, pesawat udara, bandar udara, pangkalan udara, angkutan udara, keselamatan dan keamanan penerbangan serta fasilitas penunjang dan fasilitas umum lain yang terkait, termasuk kelestarian lingkungan di wilayah NKRI b. Semua pesawat udara asing yang melakukan kegiatan dari dan/atau ke wilayah NKRI c. Semua pesawat udara Indonesia yang berada di luar wilayah NKRI Ruang Lingkup Belakunya Undang-undang
Operasi Pesawat Udara Pasal 41 (1) Setiap orang yang mengoperasikanpesawatudarauntukkegiatanangkutanudarawajibmemilikisertifikat. (2) Sertifikatsebagaimanadimaksudpadaayat (1) terdiriatas: a. sertifikat operator pesawatudara (air operator certificate), yang diberikankepadabadan hokum Indonesia yang mengoperasikanpesawatudarasipiluntukangkutanudaraniaga; atau b. sertifikatpengoperasianpesawatudara (operating certificate), yang diberikankepada orang ataubadanhukum Indonesia yang mengoperasikanpesawatudarasipiluntukangkutanudarabukanniaga. (3) Sertifikatsebagaimanadimaksudpadaayat (2) diberikansetelah lulus pemeriksaandanpengujiansertapemohonmendemonstrasikankemampuanpengoperasianpesawatudara.

SANCTIONS IN THE CIVIL AVIATIONS 1. CRIMINAL SANCTIONS: • Chapter XXII (Criminal sanctions), articles 401 - 443 • Sentencing of maximum fifteen yearsand • Fine of maximum Rp. 15.000.000.000,- (fifteen billion rupiah) • Violation on corporate level could bring fine 3 times as much 2. ADMINISTRATIVE SANCTIONS: • Several articles in Aviation Law No. 1/2009 • Government Regulations No. 3 year 2001articles 99 to 102 • Minister Regulations no. PM 78/2017 (imposing penalty units) • DG Decree KP 623 year 2015, Procedure and mekanism to impose administratif sanctions for violation of aviation regulation. • Sanctions: Warning letters 1 to 3 (one month interval), suspension of certificate/permit for 3 months, and revocation of certificate/permit
It is the DGCA duty and responsibility to ensure safety in all civil aviation matters. This carried out by prescribing and revising from certain minimum safety standards are generally issued in the form of civil aviation safety regulation (CASR) CASR are prescribing as minimum standards, are often written in a broad and general sense to give the aviation community latitude (luas) to develop higher safety standards in their own product and or operation. Staff Instruction directs the activities of DGCA inspectors responsible for the certification, technical administration, and surveillance of AOC, AMO, ATO (PSC 141, TCC 142, AMTO 147) and certain other air operators conducting operations in accordance with the appropriate part of CASR, certificated airmen, and other aviation activities. Staff Instruction also provides direction for the AOC holder, AMO holder, approved training organization, and applicant dealing with DGCA related with certification, technical administration and surveillance AOC, AMO, ATO and certain other air operators. GROUP 1 General Guidance and Information This group provide general information related with the staff instruction organization use revision, description of the organization's activities within DAAO, Human resources Development of DAAO Personnel and Inspector Training System of DAAO Personnel. GROUP 12 RPAS This group contains direction, guidance and procedureRemotely Piloted Aircraft System (RPAS) operation. GROUP 11 SSP & SMS Policies & Procedure This group contains direction, guidance and procedure for State Safety Program (SSP) and Safety Management System (SMS) implementation. GROUP 2 Organization Certification This group provide guidance for certification process. The purpose of the certification process is to provide a means by which prospective AirOperator Certificate, Approve Maintenance Organization, Approve Training Organization or other organization are authorized to conduct business in a manner which complies with all applicable regulations and Aviation Act number 1 year 2009. GROUP 10 Compliance & Enforcement This group contains direction, guidance and procedure for imposition of administrative sanctions against violation of the aviation law and regulations. GROUP 3 General Technical Administration This group provides general process of approval or acceptance of certain operations, programs, documents, procedures, methods, or systems is an orderly method used by DGCA inspector to ensure that such items meet regulatory standards and provide for safe operating practices. SI 8900-1.1 STAFF INSTRUCTION ORGANIZATION, USE AND REVISION GROUP 9 Certification For Products and Parts This group contains direction, guidance, and procedures for certification of product and parts. Applicable regulations include CASR part 21, 23, 25, 27, 29, 31, 33, 34, 35, 36, 39, 45 or 47. GROUP 4 Aircraft Equipment and Authorization This group provides an explanation of navigational concepts, direction, and guidance used by DGCA Inspector to evaluate requests for authorization to conduct en route operations. It also discusses methods and requirements necessary to approve or deny requests for proposed operations using aircraft and/or navigation systems new to that operator and proposed operations into new areas of en route operation using previously approved aircraft and navigational systems. GROUP 8 DGCA Designess This group provides inspector guidance regarding designated examiners who work in air transportation. Applicable regulations for CASR part 183 GROUP 6 Surveillance & Inspections This group contains direction, guidance, and procedures for surveillance and inspection. Applicable regulations include CASR part 60, 91, 121, 129, 133, 135, 137, 141, 142, 145 or 147. GROUP 7 Investigations This group contains direction, guidance, and procedures for investigations and reporting, related with aircraft accident, serious incident, incident and also conduct complaint and violation investigation.
