  2. Trade Rules 2010 • General • Modification and simplification based on the same order of the Customs Law. • In effect on July 1st. 2010 • Update your legal fundamentation in your import export operations.

  3. Modifications • Rule 1.3.4 (before 2.2.4) Suspension from list of importers and specific sectors. • It modifies that if you submit false documents you are subject to suspension, but not if the documents have a false field.

  4. Modifications • Rule 1.4.18. (before 1.3.11) Payment of services to Customs Broker. • Modification. The payment has to be done by check or electronic transfer from who requests the service. It used to say that the payment had to be done by the importer or exporter.

  5. Modification • Rule 2.4.14 (before 2.4.19) Merchandise with trademarks. • With the objective of detecting irregularities in intellectual property, Mx Customs will create a data base with information provided by the owners of the trademarks. This will be used during the customs process. Effective 2011.

  6. Modification • Rule 3.1.11 (before 2.6.20) Documents needed to apply preferential duty in Trade Agreements. • In-bond control thru US, CA, Europe into Mexico is not needed for Israel Trade Agreement.

  7. Modifications • Rules 3.7.22 & 3.7.28 (before 2.12.2) Fines • This rule was divided into 2. Rule 3.7.22 Benefits if Customs finds errors during importation or in audits. Ex.Error in classification you will be fined only with an administrative fine if the description is correct. Rule 3.7.28 No fine if there is an error that doesn’t affect statistics, rectif.

  8. Modification • Rule 3.8.4 (before 2.8.3) Benefits for Certified IMMEX. • The benefit that permits the temporal importation of reusable packing materials for IMMEX now applies to all certified companies. Declare separately with $1.00 dollar value. It also applies to consolidated pedimentos.

  9. Modifications • Article 5. Option to present pedimentos not validated by Customs. • Establishes procedure to present any pedimento that for any reason was not validated by Customs. Must present valid documents and not be in an audit process.

  10. Modifications • Annex 1. Formats. • Annex 51 is new. Form to modify information in the list of importers or specific sectors. It used to be an open format.
