  1. Omnibus Recreational Accountability Amendment • Bluefish Amendment 4 • SMB Amendment 17 • SF-SC-BSB Amendment 19 Tab 4

  2. Omnibus Recreational Accountability Amendment National Standard 1 Guidelines AMs for when the ACL is exceeded. On an annual basis, the Council must determine as soon as possible after the fishing year if an ACL was exceeded. If an ACL was exceeded, AMs must be triggered and implemented as soon as possible to correct the operational issue that caused the ACL overage, as well as any biological consequences to the stock or stock complex resulting from the overage when it is known.

  3. Omnibus Recreational Accountability Amendment

  4. Omnibus Recreational Accountability Amendment Pro-Active AM

  5. Omnibus Recreational Accountability Amendment In Season Reactive AM … monitor recreational landings… At such time that the available data indicate that the recreational harvest limit has been met or exceeded… …notification… the recreational fishery in the EEZ shall be closed

  6. Omnibus Recreational Accountability Amendment 2012 Black Sea Bass RHL = 1.32 M lb (adjusted for RSA) 2012 Black Sea Bass ACL = 2.52 M lb Est. 2012 Rec. Landings through Wave 4 = 2.20 M lb Federal Register/ Vol. 77, No. 207 / Thursday, October 25, 2012 – Fishery Closed Nov 1, 2012

  7. Omnibus Recreational Accountability Amendment Post Season Reactive AM If 3-year average catch estimate > 3 year average ACL the exact amount of the landings overage (in pounds) will be deducted, as soon as possible, from a subsequent single fishing year recreational sector ACT. Phased in: 2012 (1 year), 2013 (2 year), 2014 (3 year)

  8. Omnibus Recreational Accountability Amendment 2012 Black Sea Bass Overage 2012 Rec ACL = 2.52 M lb Est. 2012 Rec. Catch = 4.13 M lb Overage = 1.76 M lb Revised 2013 RHL = 0.09 M lb

  9. Omnibus Recreational Accountability Amendment Black Sea Bass Stock Status Overfished ? No Overfishing? No Catch / OFL ~ 6 M lb / 7 M lb

  10. Omnibus Recreational Accountability Amendment • Is there a viable alternative to the current recreational AM approach? • Examples from other Councils suggest a broad range of AM responses • NEFMC • bag, size, season, no payback, RA has authority to determine mgmt measures through rulemaking • SAFMC • discretionary payback, variable, and conditioned on stock status.

  11. Omnibus Recreational Accountability Amendment National Standard 1 Guidelines These AMs could include, among other things, modifications of inseason AMs or overage adjustments. For stocks and stock complexes in rebuilding plans, the AMs should include overage adjustmentsthat reduce the ACLs in the next fishing year by the full amount of the overages, unless the best scientific information available shows that a reduced overage adjustment, or no adjustment, is neededto mitigate the effects of the overages.

  12. Omnibus Recreational Accountability Amendment • Is there a viable alternative to the current recreational AM approach? • Pro-Active • In-Season Reactive • Post Season Reactive

  13. Omnibus Recreational Accountability Amendment • Pro-Active AMs • ACT • No Action • Require explicit consideration by MC of a reduction from ACL • Specify reduction from ACL • 10% (ACT = 90% of ACL) • 3-year Average of SE (ACT = ACL – SE) • etc. • Specify ACT by Wave • Bag, Size, Season

  15. Omnibus Recreational Accountability Amendment

  16. Omnibus Recreational Accountability Amendment • Pro-Active AMs • ACT • No Action • Require explicit consideration by MC of a reduction from ACL • Specify a reduction from ACL in the reg. language • 10% (ACT = 90% of ACL) • 3-year Average of SE (ACT = ACL – SE) • etc. • Specify ACT by Wave • Bag, Size, Season

  17. Omnibus Recreational Accountability Amendment • In-Season Reactive AMs • No Action • Project landings within a season • Eliminate in-season closure authority

  18. Omnibus Recreational Accountability Amendment • In-Season Reactive AMs • No Action • Project landings within a season • Eliminate in-season closure authority

  19. Omnibus Recreational Accountability Amendment In-Season Projections Black Sea Bass Average Wave 4-6 Landings 2009-2011 = 65.7% 2012 Wave 1-3 Landings / (34.3%) = 1.19 M lb / 0.343 = 3.475 M lb

  20. Omnibus Recreational Accountability Amendment In-Season Projections Black Sea Bass

  21. Omnibus Recreational Accountability Amendment In-Season Projections Black Sea Bass 90% of RHL harvested in Wave 3

  22. Omnibus Recreational Accountability Amendment • In-Season Reactive AMs • No Action • Project landings within a season • Eliminate in-season closure authority

  23. Omnibus Recreational Accountability Amendment • Post-Season Reactive AMs • Two Parts: • Trigger (“If…”) • Response (“Then…”)

  24. Omnibus Recreational Accountability Amendment • Post-Season Reactive AM Triggers • No Action • Rec catch est. > Rec ACL (phased in 3-year ave) • Five Year Averaging • Skip phase-in

  25. Omnibus Recreational Accountability Amendment Post-Season Reactive AM Triggers

  26. Omnibus Recreational Accountability Amendment • Post-Season Reactive AM Triggers • Rec catch est. > ACL and total catch est. > ABC • 2012 BSB ABC = 4.500 M lb • Total Catch ~ 6.00 M lb

  27. Omnibus Recreational Accountability Amendment • Post-Season Reactive AM Triggers • Rec catch est. > ACL and Total catch est. > OFL • 2012 BSB OFL = 7.000 M lb • Total Catch ~ 6.00 M lb

  28. Omnibus Recreational Accountability Amendment • Post-Season Reactive AM Triggers • Rec catch est. > ACL and F est. > Fmsy • Not available until assessment update

  29. Omnibus Recreational Accountability Amendment • Post-Season Reactive AM Triggers • Range of rec fishery catch est. at a given confidence level > ACL (50% CI, ± 1 SE) • Year Species Landings PSE LCL UCL

  30. Omnibus Recreational Accountability Amendment • Post-Season Reactive AM Triggers • Range of rec fishery catch est. at a given confidence level > ACL (50% CI, ± 1 SE)

  31. Omnibus Recreational Accountability Amendment • Post-Season Reactive AM Responses • No Action • Scaled to stock condition • No payback at B≥Bmsy, 100% payback • at B≤ ½ Bmsy • No payback at B/Bmsy ≥ 125%, 100% payback at B/Bmsy ≤ 75%

  32. Omnibus Recreational Accountability Amendment • Post-Season Reactive AM Responses • Payback is by wave • Pound for Pound • Scaled to stock condition

  33. Omnibus Recreational Accountability Amendment

  34. Omnibus Recreational Accountability Amendment • Post-Season Reactive AM Responses • Bag, Size, Season adjustment

  35. Omnibus Recreational Accountability Amendment Recommendations Confirm that National Standard 1 Guidelines provide for enough discretion in the application of AMs so that the condition of a fish stock based on best scientific information can form the basis for the nature and magnitude of an AM response. Uncertain nature of recreational fisheries (catch estimates, management controls) necessitates different management approach/response than for commercial fisheries. Continual adjustment of annual management measures may not be necessary when annual variability in catches is below the level of biological significance.

  36. Omnibus Recreational Accountability Amendment Recommendations When best scientific information on stock condition indicates no mitigation [payback] is needed (e.g., when B/Bmsy >1, F/Fmsy <1) that overage paybacks need not be invoked. Decide ahead of time whether prevention of overage in-season is better for a fishery than [potentially drastic] reductions in future fishing opportunity.

  37. Omnibus Recreational Accountability Amendment Pro-Active AMs Recommendation: 1.1 No Action 1.2 MC will recommend an ACT…including explicit consideration of a reduction from the ACL based on uncertainty in recreational landings estimates 1.3 MC will identify bag, size, season combination to prevent rec ACL from being exceeded Advise against a prescriptive reduction from ACL (10%, 25%, 1 SE, etc.) for determining ACT, as well as establishing ACT by wave.

  38. Omnibus Recreational Accountability Amendment Inseason AMs Recommendation: 2.1.1 No Action 2.1.2 R.A. … shall consider in-season projectionsof landings as a basis for determining whether the recreational harvest limit will be met prior to the close of the fishing season Advise against elimination of in-season closure authority (2.2)

  39. Omnibus Recreational Accountability Amendment Post – Season Reactive AMs Recommendation: Triggers: (Include averaging options) 3.1 No Action 3.2 Rec ACL has been exceeded and combined Rec/Com ACL (ABC) has been exceeded 3.3 … and OFL has been exceeded 3.4 … and an assessment update indicates Fmsy was exceeded 3.5 ... the range of catch estimates is above the (rec. ACL, ABC, OFL)

  40. Omnibus Recreational Accountability Amendment Post – Season Reactive AMs Recommendation: AM Response to Trigger Overage deduction 4.1 No Action (pound for pound deduction from rec. ACT) 4.2 Scaled overage deduction from rec. ACT based on B/Bmsy 4.2.1 - 4.2.n Scaling Options 4.3 Overage deduction by wave (advise against) 4.4 Bag, size, season adjustment 4.5 Monitoring of subsequent season such that potential for another overage is prevented through in-season closure.

  41. Omnibus Recreational Accountability Amendment • Post – Season Reactive AMs • Recommendation: • AM Response to Trigger • Arrange “Triggers” and “Responses” so that a range of options exists contingent on • severity of a given overage • condition of stock

  42. Omnibus Recreational Accountability Amendment B/Bmsy > 1 Payback OFL 1>B/Bmsy > 0.5 B/Bmsy < 0.5 B/Bmsy > 1 Recreational Catch Estimate is Above Adjust Bag, Size, Season ABC 1>B/Bmsy > 0.5 B/Bmsy < 0.5 B/Bmsy > 1 Monitor Subsequent Season for Early Closure Rec ACL 1>B/Bmsy > 0.5 B/Bmsy < 0.5

  43. Omnibus Recreational Accountability Amendment B/Bmsy > 1 Payback OFL 1>B/Bmsy > 0.5 B/Bmsy < 0.5 B/Bmsy > 1 Recreational Catch Estimate is Above Adjust Bag, Size, Season ABC 1>B/Bmsy > 0.5 B/Bmsy < 0.5 B/Bmsy > 1 Monitor Subsequent Season for Early Closure Rec ACL 1>B/Bmsy > 0.5 B/Bmsy < 0.5
