Importance of CJ Process and Determinations • Product and technology classification is a fundamental aspect of any export licensing analysis • § 120.4 provides a process through which classifications can occur • Clarity concerning the § 120.3 criteria for classifying products or technology as USML items is key to ensuring determinations which meet the objectives of the Arms Export Control Act 1

Tasks accomplished and to be continued • Review the current CJ process • Identify issues related to the CJ process that may benefit from revision or clarification • Identify consistencies and inconsistencies in CJ determinations, policies for designating defense articles, and similar issues • Draft and suggest possible revisions to the CJ process or ITAR language related to classifications 2

Status • The Working Group met on April 22, 2005 • Based on the meeting, the Working Group intends to work with State to: • focus on the § 120.3 criteria for making CJ decisions • discuss and clarify the documentation to be submitted to State to permit the Government to make a CJ determination; and • understand the CJ template currently under development to provide comments on maximizing its use and effectiveness. 3
