  2. The Breakdown What does discrimination in the workplace look like? Every situation is different and is dependent on the type of discrimination. Please review the most common types of workplace discrimination below to become more familiar. Disability Discrimination: This form of discrimination occurs when an employer treats an applicant or employee with a disability unfavorably. Harassment can be identified through the use of offensive remarks, isolated incidents, being fired or demoted due to their disability, or inappropriate comments or teasing.

  3. Age Discrimination: This form of discrimination occurs when an individual treats an applicant or employee unfavorably due to their age. The ADEA, Age Discrimination in Employment Act, protects those who are 40 or older. Harassment can be identified through the use of offensive remarks, isolated incidents, being fired or demoted due to age, or inappropriate comments or teasing. Sexual Harassment: It is against the law to harass an applicant or employee due to their sex. This includes requests for sexual favors, unwelcome sexual advances, or various other forms of verbal and physical harassment that are

  4. sexual in nature. Harassers and victims can be either gender or the same sex. Harassment becomes illegal when its severity or frequency results in an offensive or hostile work environment. Also, when an adverse employment decision is made, such as, a victim of sexual harassment being fired or demoted. Pregnancy: This form of discrimination occurs when a woman is being treated unfavorably due to pregnancy, child birth or any condition(s) related to pregnancy / childbirth. The PDA, Pregnancy Discrimination Act, forbids discrimination in any aspect of employment such as pay, hiring, firing, training, layoffs or fringe benefits such as leave, health insurance or other terms and conditions associated with employment.
