  1. Amusement Park Accidents - Paul Dansker & Aspromonte According to the Nationwide Children’s Hospital in Ohio, more than 92,000 children suffered amusement park and roller coaster-related injuries from 1990 to 2010, averaging nearly 4,000 injuries per year. Roller coaster death numbers are also relatively high, with 52 deaths between 1990 and 2004, meaning there was an average of 4 deaths per year nationwide. If you or someone that you loved was injured in an amusement park or roller coaster accident, Paul Dansker an experienced attorney can help you to receive the compensation that you deserve. By their nature amusement parks are risky locales. While the risk and thrill of park rides can be exciting, it can also be devastating if something goes wrong. Ride accidents can happen at high speeds or heights which can cause serious injury and even death. Causes of Park Accidents Accidents can occur at either permanent, fixed attractions, such as the rides found at an established amusement park like Six Flags or Disney World, or they may be experienced on mobile rides. These attractions are moved to different sites, possibly even to different states, such as those found in county fairs and carnivals. The occurrence of theme park accidents is most commonly due to one or more of the following: Ride operator negligence Mechanical failure of ride components Defects in the design of the ride Negligent maintenance If you have sustained injuries from an amusement park ride, the ride's operators, maintenance crew, engineers, or architects may be liable. Park Ride Risks

  2. In some cases it is difficult to obtain data on theme park accidents, because some states do not require the parks to disclose accident data to the public. The lack of regulation on accident monitoring and reporting makes it more difficult to calculate the risks involved in riding roller coasters and other rides. Unfortunately, this lack of surveillance may also suggest that there is less accountability for ride injuries than there should be. The Consumer Protection Safety Commission estimates that injuries requiring emergency room treatment are becoming increasingly common: the number of reported ER injuries due to ride accidents rose by more than 80 percent in the past five years. Amusement Park Accident Liability When an accident occurs at the amusement park, liability or who is responsible is a major cause for concern. Since accidents can be caused by rider behavior, mechanical failure, design limitations, and operator behavior, liability varies on a case by case basis. There are several common claims that are made most often against amusement parks when an accident or injury occurs: Failure to give proper warnings or instruction Failure of the facility to keep rides in safe operating condition through proper inspection and maintenance Failure to warn people with chronic health conditions to avoid certain attractions Failure to keep public areas and walkways safe. Inherently dangerous ride design Parents need to be especially vigilant. Make sure that you are monitoring your child as the ride progresses, and observe the operator’s behavior when your child enters a ride. Also make sure that you are explaining safe behavior to your child before your trip to the amusement park so that your entire family is on the same page.
