MYFA Implementation • Senate Bill 272 signed by Governor Brownback on March 5 • Eliminated mandatory 10% conservation factor • Provides NIR alternative for MYFA quantity • Allows GMD to develop a 3rd option for Q calculations • Flexibility within a water right, not to increase long term use • Application form made available on May 10 • Revised form made available June 25 • Filing deadlines of 7/15 and 10/1 • Information meeting in Great Bend 9/11 with KFB • Almost 400 received to date • ¾ are drought term conversions

Applications by the Numbers July 14, 2011 Today 908 total pending new applications 429Regular Applications 14 pending DT 97 pending term (non-DT) 388 MYFA applications have been filed so far (293 DT conversions - 76%) 2,256 drought term permits processed since implementation 595 temporary applications 238 total pending change apps • 322 total pending new applications • 314 temporary applications (oil and gas exploration) • 193 total pending change applications

  5. Drought Terms and Enforcement • Prolonged drought • Committed not to increase or decrease enforcement activity. • If your drought term is overpumped cease pumping to avoid a fine • No additional DT, MYFA is the tool • Aquifer neutral

  6. Drought Terms and Enforcement • Choose not to enroll in a MYFA after overpump occurs • Penalty will be $500 and a suspension of the amount overpumped • Reduces the use in 2013 • If overpumped before, the fines and penalties could be significantly greater

  7. LEMA Implementation • GMD No. 4 in the process of implementing a LEMA in Sheridan 6 • Revised Management program has been approved by the Chief Engineer and adopted by the GMD (July 2012) • Sheridan 6 LEMA proposal approved. • First Hearing is Sept 13

LEMA Implementation (con’t) • Two hearings required: • Initial hearing to determine if LEMA corrective controls are needed to address water resource problem and preliminary confirmation of boundary • Second hearing to determine whether to adopt the GMD’s proposed corrective controls • Developing implementing regulations • We will move forward with Sheridan 6 hearings under statutory guidance and IGUCA regulations adopted in 2010 consistent with statute.

  9. HB 2451 - Abandonment • Applies to areas closed by rule or order of the chief engineer, groundwater only • Water Use reports still required

  10. HB 2516 – Water Banking • Review GMD 5 bank review committee recommendations • Implement results in revised bank charter and regulations.
