  22. Deck Form Boards Contractor used 11/32” plywood. Requirement is now 5/8” nominal thickness.

  23. Warpage: Contractor was required to remove this plywood on the remaining spans; 3 and 4.

Where we are now. • July 12, 2008 ~ Sent Ross Bros. a letter of Termination for Default. • July 21, 2008 ~ ODOT received proposals from both the contractor and the surety. • July 24, 2008 ~ ODOT rejected Ross’ proposal, but agreed to pursue Safeco’s 2nd proposed option. Per the Standard Specifications, the contractor and their surety have the ability to propose a cure to the project with in 10 days of the notice. Ross’ proposal kept them as the Prime Contractor. Safeco’s proposal had 2 options; 1) keeping Ross as the prime and 2) Safeco taking over the contract and hiring a completion contractor.

Where we are now. • September 15, 2008 ~ ODOT signed a Takeover Agreement with Safeco. • Highlights of Takeover Agreement • Safeco is now the Prime Contractor; • Safeco is allowed to use Ross Brothers; • Safeco will provide on-sight Project Manager • Safeco will assume Superintendent responsibilities per the STD Specs 150 section; • Safeco will reimburse ODOT ± $2M for stem wall repairs and investigation; • Safeco will reimburse ODOT ± $1.1M for continued CEI costs; • Safeco will reimburse ODOT ± $426K for LD’s; After 7 weeks of back and forth negotiations, ODOT and Safeco came to agreement.

Where we are now. • Highlights of Takeover Agreement; (cont) • Agreement established a new interim and new completion date; • October 31, 2010 – All work complete except for site restoration, clean up, punch list, pier and falsework removal, planting, etc. • August 31, 2011 – Final completion – All work must be complete. • September 29, 2008 ~ Safeco was provided an NTP to proceed with the work under the new agreement. • October 31, 2008 ~ The NB South Umpqua River Bridge was open to traffic.
