Omnibus; JTEDs HB2128 • Maximum student count is 1.75 with max for either entity of 1.0 (Central Campus) • Name now is Joint Technical Education District • Defines a JTED education program • Expand agreements to include IEP for special education students • Stipulates responsibility and data requirements for JTEDs

  3. JTED Funding HB2127 • Not withstanding any other law for FY2010-2011 a school district may sell any school property to a JTED with an existing central campus (FY2011) • JTED may generate average daily attendance for any hour of the day, during any day of the week beginning July 1 through June 30 for any satellite program.

  4. Prohibited Courses HB2281 • Prohibits School District or Charter from having classes: • Promote overthrow of U.S. Government • Promote resentment toward a race or class of people • Designed primarily of pupils of a particular ethnic group • Advocates ethic solidarity instead of the treatment of pupils as individuals • SBE or Superintendent may withhold up to 10% of monthly state aid for non-compliance • Subject to appeal to an administrative hearing • Exemptions

  5. HB 2129 (Arizona online instruction; reform) • Clarifies the definition of full-time and part-time students • Repeals current AOI hour requirements and adds new definitions

HB 2227 (schools; teacher contracts; acceptance) • Requires a teacher to return his/her contract within 15 business days upon receipt rather than the current 30 days. • Includes the changes school personnel issues included in HB 2011 passed in the 2009 3rd Special Session • Mooted AEA Lawsuit, which was later dropped

HB 2521 (schools; superintendent contracts; performance pay) • Requires a Superintendent’s contract to include at least 20% for performance pay • Allows a school district governing board to determine what that performance pay looks like OR implement the following: • 25% based on the outlined formula for academic gain • 25% parental satisfaction survey • 25% teacher satisfaction survey • 25% governing board criteria

Counting Students • HB2385 • Problems with SAIS • Pick points in time instead of 100 day average – September 15, November 15, January 15 and March 15 • Funding on membership but absence data must still be reported • Delayed implementation (Effective June 30, 2011) • Example is STAR in New Mexico • 200 Day Calendar - 5% base level increase/ Must increase Instructional Hours by 10% • Timelines for ADM counts – example April 22

HB 2386 – Override Elections • Provides technical corrections to override laws • Removes requirement to budget and report separately for special program overrides and eliminates ability to carry forward 50% of unspent special program override • Holds districts harmless for reductions to overrides from elimination of Group B K weight (Senate Education Amendment • Would have held districts harmless for reductions to overrides from reductions to base level if sales tax election fails ($102 million) Senate Education Amendment

HB 2298 (teacher certification; preparation providers) • Requires the State Board of Education to allow a variety of teacher preparation program providers to offer a variety of preparation models and courses of study for alternative certification • In March, the SBE adopted rules to: • Create a streamlined application and evaluation procedure for organizations seeking approval as Alternative Programs • Clarifies that a variety of public and private organizations may qualify as approved programs • Changes program approval from 10 years to 7 years

Student Tuition Organizations (STO) • HB 2663 (STOs; corporate tax credit requirements) • Makes a number of changes to the STOs that accept corporate income tax credits based on the recommendation from the Ad Hoc Committee on Private School Tuition Tax Credit Review. • HB 2664 (STOs; tax credit requirements) • Makes a number of changes to the STOs that accept individual income tax credits based on the recommendation from the Ad Hoc Committee on Private School Tuition Tax Credit Review.

Student Tuition Organizations (cont.) • SB 1274 (STOs; contribution date) • allows a taxpayer to take an individual or corporate income tax credit for donations made to an STO until April 15th  to either the previous tax year or the current tax year. • A fiscal note was done on this bill with the Joint Legislative Budget Committee (JLBC) estimating this would result in a $2.9 million decline in state revenues and that 5400 students would have to switch from public schools to private for it to be a revenue neutral measure.

Nonresidents of the state HB2722 • Prohibits School Districts and Charters from obtaining state funding for non-residents of the state except for existing exemptions • Existing exemptions for children of teaching and research faculty and certain graduate or undergraduate and graduate students at community colleges and state universities. • Existing exemptions for children under certain conditions which best serve the child’s physical, mental, moral or emotional health

  14. HB2725 Education Omnibus • Charter school changes • Teacher certification changes • Eliminates bid requirement for Special Ed. Students placed in ADE approved private schools • Allows district board to establish multiple bank accounts to deposit miscellaneous receipts • Reduces required time in 7th and 8th grades from 1068 to 1000 hours • School advertising expanded • Special accounting procedures for impact aid • Allows impact aid to off set soft capital cuts (zero primary and secondary rates)

HB2725 Education Omnibus (Con’t) • Recess Policies • Requires governing board of school districts and charter schools to conduct a public meeting to consider adoption of a policy to provide at least 30 total minutes of recess each day for grades K-5 • Governing bodies must discuss and vote on the adoption of a recess policy • Recess must constitute of structured physical activity outside or inside the classroom • Unstructured time after lunch does not count but PE classes do count

  16. “Move On When Ready” • HB 2731 (high schools; graduation; board examinations) • Creates the Grand Canyon Diploma to allow high school students to choose different educational pathways. • Voluntary for school districts and charter schools to participate • Track 1 -- community college • Track 2 -- remain in high school, advanced prep board exams • Track 3 -- career and technical education program • Track 4 -- current system

  17. “Move on When Reading” • HB 2732 (schools; third grade retention) • Establishes the Task Force on Reading Assessment to report by February 15th, 2011 (Task Force repealed as of September 15, 2011) • Requires that a student not be promoted from the 3rd grade if the student obtains a score on the reading portion of the AIMS test, or a successor test, that demonstrates that the student is reading far below the 3rd grade level • Beginning in school year 2011-12, requires districts to provide annual written notification for those reading far below that he/she will not be promoted in 3rd grade • Requires the State Board of Education (SBE) to develop intervention and remedial strategies • Requires school districts to offer at least three of the intervention and remedial strategies developed by the SBE chosen by the parent or guardian of a student who is not promoted from the 3rd grade, beginning in school year 2012-2013.

Dept. of Education/ Data Collection HB2733 • Subject to appropriation of state funds, receipt of federal funds or private donations the Supt. of Public Instruction shall contract for the evaluation of SAIS and the Data Warehouse includes specifics of what is to be included in the evaluation • Subject to the same funding availability request proposals to replace or update SAIS with specifics of what is to be included • Sets up a Data Governance Commission at ADE including representative from Universities, Community Colleges, School Districts, Charter Schools, CEO of the Arizona Early Childhood Development and Health Board, Business and the Superintendent of designee • Sets up a member Task Force on Data Systems to design Request for Proposals.

  19. SFB Preventative Maintenance Guidelines HB2760 • Requires a roof inspection before any repair or replacement of roof elements or mounted equipment • Requires as part of the routine preventative maintenance program visual inspections of roofing systems for signs of structural weakness

SFB Vacant Land SB1187 • Allow SFB to require a school district to sell land purchased entirely with SFB monies if land is not needed for a new school or an addition to a new school (10 year period of time) • Prohibits a school district from using land purchased or partially purchased with SFB for a purpose other than a school without SFB written authorization • Prohibits a school district from leasing or selling or taking any action that would reduce the value of land purchased or partially purchased with SFB money

Teacher and Principal Evaluations • SB 1040 (teacher and principal evaluations) • Requires the State Board of Education (SBE) to adopt and maintain a model framework for a teacher and principal evaluation instrument that uses quantitative data on student academic progress for at least 33 and up to 50% of the evaluation outcomes and best practices for professional development and evaluator training by December 15, 2011 • Requires school districts and charter schools to implement usage for school year 2012-13

School Labels • SB 1286 (schools; achievement profiles; letter grades) • Includes school districts into the current AZ Learns labeling system • Changes the current labels from excelling to failing to meet academic standards to A through F. • 50% of the school and district classification must be on academic performance measurements and 50% must be on all student academic gain and 50% on the measurement of the lowest 25% of students making academic gain. • Effective August 31, 2011; two years of overlapping labels

  23. School District Annual Tax Estimate SB1188 • Requires Count. School Superintendents to report to Property Tax Oversight Commission estimated monies needed for each school district for the upcoming year (Setting Tax Rate) • Requires each school district to certify projected ending cash balance used to set tax rate – Governing Board President or Board delegates Superintendent, Head Teacher or Business Manager • For 2009-10 May 15, 2010 budget adjustment deadline is extended to July 15, 2010

SB1284 School Finance Revision • Specifies the base level includes % increases related to optional 200 day average membership, career ladder, optional performance incentive and teacher compensation. • As permitted by the Arizona Constitution and unless otherwise specified by law changes to school finance formulas apply to entire fiscal year. • Districts prohibited from receiving more than three fourths of total apportionment before May 1 • Changes to Classroom Site Fund budget amount ($120 for FY2011 and supplanting modifications for FY2011 expenditures.)

  29. Amendment to SB1284 Supplanting/ Classroom Site Fund • Additional teacher compensation money from sources other than Classroom Site Fund for FY2011. • Not considered supplanting for FY2012 calculation.

  30. Schools; Instruction; Dating Abuse SB1308 • Grades 7-12 may incorporate age appropriate dating abuse information into existing healthy curriculum • On or before June 30, 2011 a school district shall conduct a public meeting to review and consider adoption • A school district that already adopted a policy before the effective date of this new law is exempt

HB2389– ASRS Plan Changes (Impacts hires after July 1, 2011) • Change 80 points to 85 points • Retirement calculation based on 60 months, not 36 months • Member who leaves gets member contributions plus interest • Return to work still an issue • Member who leaves because of budget cuts or job elimination get current share of employer contribution plus member contributions

  32. Parent Rights • SB 1309 (Parents; rights) -- • Outlines extensive parental rights related to healthcare, education, recordings, scans, genetic testing and the upbringing of a minor child. • Sex education becomes opt-in • Requires the school district to outline procedures to learn of numerous items related to parent rights and responsibilities. • Allows a district governing board to prescribe a policy to provide this information in an electronic format

  33. Government Transparency • HB2282 – Website information on receipts and expenditures. ASBA and AASBO oppose and tried to get an alternative put in place. • Implementation date January 1, 2013 • Available on website – all revenues and expenditures over $5,000 • Be searchable, updated at least every 3 months and retained for at least 3 years • To mirror requirements for ADOA Website (January 2, 2011)

  34. Repeal of First Things First • HCR 2001 (early childhood development; health; repeal) • Will appear on the November 2010 ballot • Repeals First Things First • Sweeps current First Things First funds into the state general fund • Redirects future tobacco tax revenues for “health and human services for children”
