BIGGERT-WATERS – FLOODPLAIN MANAGEMENT A Senate bill (S.1846) to delay almost all of the 2012 reforms and resulting premium hikes for four years has been sidetracked but supporters have not given up. In a tactical move last week, the Senate paired the flood insurance bill with the NARAB II bill (S.534 National Association of Registered Agents and Brokers Reform Act), which seeks to streamline agent licensing. The Independent Insurance Agents and Brokers of America (Big “I”), the main group behind NARAB, supports the Senate flood bill and also supports the pairing of the two as a way to gain a vote on NARAB and bypass opposition to NARAB by Sen. Tom Coburn, R.-Okla. The move means both will either pass or die together in the Senate and then be taken up by the House as a package. Even if the Senate approves the package bill, it appears that the House will only consider a narrower fix to Biggert-Waters and that might take some time to negotiate. Speaker John Boehner said the House will not consider a four-year delay in flood insurance reforms and premium increases, as the Senate is weighing.

Minimum standards for construction of groundwater wells, fresh water observation wells, and water well test holes (a) General requirements. (1) Minimum standards. The minimum standards set forth in this subchapter apply to all groundwater wells, fresh water observation wells and water well test holes whether constructed by a person having a valid license or by any other person. More stringent construction standards may be required for areas of known contamination as identified in Chapter 45, Appendix H, or shown as higher pollution risk areas on Aquifer Protection Maps attached as Appendix ___ and published on the OWRB’s Interactive Maps web page, http://www.owrb.ok.gov/maps/PMG/index.html.

In addition to (c )(1) and (c )(2) above, new and replacement groundwater and fresh water observation wells within higher pollution risk areas shown on the higher risk Aquifer Protection Maps shall have outside water-tight production casing cement grouted from land surface to a minimum depth of at least thirty (30) feet below the land surface, unless a variance is issued by the Director for an alternative completion design in very shallow aquifers or as otherwise necessary due to site specific conditions: and (4) The OWRB shall use data and maps of areas where the soils and/or near surface bedrock are more likely to contain pollutants, provided by other state agencies, to determine and map these higher risk Aquifer Protection areas.
